A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
AMENDING THE FILING FEE FOR EMPLOYER EMISSION REDUCTION
PLANS SUBMITTED PURSUANT TO THE TRANSPORTATION
MANAGEMENT PLAN ORDINANCE
WHEREAS, on October 23, 1984, the Santa Monica City Council adopted the
Circulation Element of the General Plan, which directed the City to develop a
Transportation Management Plan to implement the transportation management policies
contained in the Circulation Element; and
WHEREAS, on November 12, 1991, the City Council adopted the Transportation
Management Plan (TMP) Ordinance to reduce transportation congestion on City streets
and to improve air quality through the effective management and coordination of
transportation demand and transportation systems in the City; and
WHEREAS, the TMP Ordinance allows for, in part, the establishment of an
Employer Annual Impact Fee to pay for the costs of administration and review and
enforcement of Employee Trip Reduction Plans filed by employers of fifty or more
employees who choose the Emission Reductions Options for TMP compliance, with the
amount of such fee to be set by separate resolution; and
WHEREAS, the City's cost of administering, reviewing and enforcing Emission
Reduction Plan options have increased and the South Coast Air Quality Management
District has imposed an additional fee for each employer who files an Emission Reduction
Plan through the Old Vehicle Scrapping option: and
WHEREAS, the fees established by this resolution are no more than necessary to
recover the costs of the services provided,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica approves an increase in
the Annual Filing Fee for the Employer Emission Reduction Plan filed pursuant to Santa
Monica Municipal Code Section 9.16.070(a) to $401.70.
SECTION 2. The City Council of the City of Santa Monica approves an increase in
the Annual Filing Fee for the Employer Emission Reduction Plan filed pursuant to Santa
Monica Municipal Code Sections 9.16.070(b) and 9.16.070(c) to $348.30.
SECTION 3. The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
