R-9526 RESOLUTION NO. 9526 (CCS) (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING ENVIRONMENTAL AND PUBLIC WORKS MANAGEMENT DEPARTMENT AND FIRE DEPARTMENT FEES WHEREAS, the City of Santa Monica is committed to sustainability and protection of the public health and environmental resources; and WHEREAS, the City of Santa Monica administers and implements the Underground Storage Tank (UST) Program and the Hazardous Materials Release Response Planning and Inventory (HMRRP) Program; and WHEREAS, the State adopted the Certified Unified Program in 1993, for purposes of consolidating and coordinating the administration of the Underground Storage Tank Program and the Hazardous Materials Release Response Planning Inventory Program, including the database, payment of fees, and issuance of permits; and WHEREAS, the City of Santa Monica was certified to be the Certified Unified Program Agency (CUPA) in 1997 and is, therefore. required to satisfy extensive state CUPA administrative performance standards related to the implementation of the UST Program and the HMRRP Program; and WHEREAS, the City of Santa Monica recently completed a comprehensive analysis of all user fees charged by the Environmental and Public Works Management Department and the Fire Department for the implementation of the UST program and the HMRRP Program; and WHEREAS, it was determined that current user fees charged by the Environmental and Public Works Management Department and the Fire Department do not accurately reflect the full costs incurred in the provision of related services; and WHEREAS, it is the policy of the City of Santa Monica to charge for the full costs of services provided by City staff when such services benefit individual users rather than members of the community as a whole; and WHEREAS, Municipal Code Section 5.24.150 authorizes the setting of Hazardous Materials Release Response Planning Program Fees by resolution; and WHEREAS, Municipal Code Section 8.104.100 authorizes the setting of Underground Storage Tank Program Fees by resolution, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA. DOES RESOLVE AS FOLLOWS: SECTION 1. Pursuant to Municipal Code Section 8.104.100 the following fees are established: Underqround Storaqe Tank lUST) Proqram: For each classification determination made by the Environmental and Public Works Management Department, the following fees shall be charged: NumberofUSTs Fee First UST $789 Each Additional UST $ 85 SECTION 2. Pursuant to Municipal Code Section 5.24.150 the following fees are established: Hazardous Materials Release Resoonse Planning and Inventory Program: For each classification determination made by the Fire Department, the following fees shall be charged: Classification Fee Type 1 Type 2 Type 3 Type 4 $169 $173 $366 $1,010 SECTION 3. Pursuant to Municipal Code Sections 8.104.100 and 5.24.150 the following fee is established: UST/HMRRP Proarams Administrative Fee: For each and every classification determination made by the CUPA (Environmental and Public Works Management Department), the following fee shall be charged: Fee Tyoe Fee CUPA Administration $206 SECTION 4. The fees set forth in Sections 1, 2 and 3 of this Resolution shall be effective on July 1, 2000. Beginning July 1, 2001, and on July 1 of each fiscal year thereafter, all fees established by this resolution shall be administratively revised annually by a factor equal to the difference in the Los Angeles-Riverside-Orange County Consumer Price Index for Wage Earner and Clerical Workers for the 12-month period from February through February of the prior fiscal year. SECTION 5. The City Clerk shall certify to the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect.
