A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA REVISING CURRENT USER FEES
WHEREAS, the City of Santa Monica's Environmental and Public Works
Management Department completed a comprehensive analysis of use of public property
fees charged by the department for the purpose of updating fee amounts and thereby
preserving public financial resources; and
WHEREAS, it was determined that the fees for use of public property in the City do
not reflect rental costs incurred in the City by other entities; and
WHEREAS, Santa Monica is a densely populated city and has high land values; and
WHEREAS, rental charges for the use of public property have not increased since
1988 and, therefore, do not reflect current land value; and
WHEREAS, it is the policy of the City of Santa Monica to charge the full value of
City land encroached upon when such use of public property benefits individual users
rather than members of the community as a whole; and
WHEREAS, Sections 7.04.660 and 7.04.670 of the Santa Monica Municipal Code
authorize the setting of various Public Works fees by resolution,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1.
Resolution Number 7619 (CCS) is hereby amended to set new fee
levels for the Environmental and Public Works Management Department's Use of Public
Property Permit fees as detailed in Attachment A to this Resolution.
SECTION 2.
SECTION 3.
The fees set forth in this Resolution shall be effective July 1, 2000.
Beginning July 1,2000, and on July 1 of each fiscal year thereafter,
all fees established by this Resolution shall be administratively revised annually by a factor
equal to the difference in the Los Angeles-Anaheim-Riverside Consumer Price Index for
Wage Earners and Clerical Workers for the 12-month period from February through
February of the prior fiscal year.
SECTION 4.
The City Clerk shall certify to the adoption of this Resolution, and
thenceforth and thereafter the same shall be in full force and effect.
