R-9522 RESOLUTION NUMBER 9522 (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA SETTING FEES FOR THE RELEASE OF VEHICLES IMPOUNDED UNDER THE CITY?S MOTORIST AWARENESS/30-DAY VEHICLE IMPOUND PROGRAM WHEREAS, it is the policy of the City of Santa Monica to charge for the fully allowable costs of services provided by City Staff when such services benefit individual users rather than members of the community as a whole; and WHEREAS, the City Council directed City Staff to develop a motorist awareness/30-day vehicle impound program, which targeted persons operating vehicles without valid driver licenses and which involved actions designed to dissuade them from driving unlicensed in Santa Monica. WHEREAS, the Police Department has developed such a program and one of the actions contained within the program is the impounding of vehicles driven by unlicensed or improperly licensed drivers for thirty (30) days; and WHEREAS, it is appropriate to recover City costs associated with the impounding of such vehicles; and WHEREAS, recovering a major portion of program?s cost is dependent upon charging an appropriate 30-Day Impound-Vehicle Release Fee; and WHEREAS, by preparation of a Motorist Awareness/30-Day Vehicle Impound Program cost recovery plan, the Police Department has determined that $210.00 is the appropriate fee to charge for release of a vehicle impounded, for 30 days, under that program; and WHEREAS, the 30-day vehicle impound release fee should be increased annually in proportion with increases in the Consumer Price Index, published by the United States Department of Labor to reflect inflationary increases in program costs, NOW, THEREFORE, THE CITY COUNCIL IF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The fee for release of a vehicle impounded under the City?s Motorist Awareness/30-Day Vehicle Impound Program shall be $210.00. SECTION 2. The 30-Day Vehicle Impound Release Fee set by this resolution shall be effective from July 1, 2000 to June 30, 2001. SECTION 3. Beginning July 1, 2001 and on July 1 of each fiscal year thereafter, the 30-Day Vehicle Impound Release Fee shall be administratively revised by a factor equal to the difference in the Los Angeles-Riverside-Orange County Consumer Price Index for the twelve month period February through February of the prior fiscal year. The 30-Day Vehicle Impound Release Fee will be included in the City?s comprehensive study of user fees, conducted every five (5) years, to determine if fess charged adequately cover the City costs for related services. SECTION 4. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full forth and effect.
