CA:RMM:DKW:JR:se city council Meeting: June 28, 1988 Santa Monica, California RESOLUTION NO. 7657(CCS) (city council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CERTIFYING THE FINAL SUBSEQUENT ENVIRONMENTAL IMPACT REPORT AND THE FINAL SUPPLEMENTAL ENVIRONMENTAL IMPACT REPORT ON THE PROPOSED ZONING ORDINANCE WHEREAS, a Notice of Preparation of a Subsequent Environmental Impact Report on the Draft Zoning Ordinance was issued in March, 1986; and WHEREAS, a Notice of Completion of a Draft Subsequent Environmental Impact Report was published in October 1986, in compliance with the California Environmental Quality Act (hereinafter referred to as "CEQA") and the City of Santa Monica CEQA Guidelines; and WHEREAS, in a Final December Subsequent 1986, Environmental Impact Report was prepared; and WHEREAS, as a result of revisions to the proposed Zoning Ordinance by the Planning Commission and City Council, as well as changes the environmental setting, a Supplemental to Environmental Impact Report was proposed to analyze potential impacts of the Fifth Draft Zoning Ordinance; and - I - . . compliance with the California Environmental Quality Act and the City of Santa Monica CEQA Guidelines; and WHEREAS, in June, 1988, a Final Supplemental Environmental Impact Report was prepared; and WHEREAS,in June, 1988, the City Council, as Lead City Agency, conducted a hearing on the proposed Zoning Ordinance and the Final Supplemental Environmental Impact Report, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. The city has reviewed and considered the Final Supplemental Impact Report on the Fifth Draft Zoning Ordinance. SECTION 2. The City Council finds that the Final Subsequent and Supplemental Environmental Impact Reports adequately review and analyze potential environmental effects of the proposed project. SECTION 3. Consistent with Article VI, Section 12 of the City CEQA Guidelines and section 15091 of the State CEQA Guidelines, the City Council finds that there are no reasonable and available alternatives to the project that would significantly and sUbstantially reduce the impact on the environment which would accomplish the project objectives and would be consistent with the land use goals of the City as set forth in the Land Use Element of the City's General Plan. - 2 - . . The Fifth Draft Zoning Ordinance attempts to balance goals of the Land Use Element to accomodate revitalization, land use, employment and economic development goals on the one hand while protecting aspects of Santa Monica that are unique and valued, including low building scale, the City's natural and scenic resources, and desirable residential neighborhoods, on the other hand. In addition, the Zoning Ordinance promotes goals of the Land Use Element to guide growth to those areas of the city best suited to accomodate that growth from the standpoint of access, existing infrastructure, and minimizing of impacts on adjacent residential neighborhoods. SECTION 4. The City Council hereby makes a Statement of Overriding Considerations, pursuant to Article VI, section 13 of the City CEQA Guidelines and sections 15091 and 15093 of the State CEQA Guidelines, and finds that while the Final Supplemental Environmental Impact Report indicates that there may be significant circulation impacts, these impacts will be substantially lessened by the fOllowing mitigation: (a) Implemention of the proposed Transportation Management Plan which will reduce traffic volumes over what otherwise might be expected: (b) implementation of physical improvements identified in the Land Use and Circulation Elements; (c) implementation of the physical improvements recommended in the December, 1986 Subsequent Environmental Impact Report; and (d) adoption of reduced Floor Area Ratios (FARS) contained in the Fifth Draft Zoning Ordinance. - 3 - . . Therefore, the City Council finds that the potential impacts on traffic and circulation will be mitigated to a level which is acceptable and which cannot be reasonably avoided, given the recognized need to allow sufficient growth to maintain the vitality of the city. SECTION 6. The City council certifies that the environmental review for the project was conducted in full compliance with State and City CEQA Guidelines, that there was adequate public review of the Draft Subsequent and Supplemental Environmental Impact Reports, that the City Council has considered all comments on the Draft Subsequent and Supplemental Environmental Impact Reports and responses to comments, that the Final Subsequent and Supplemental Environmental Impact Reports adequately discuss all significant environmental issues, and that the city Council has considered the contents of the Final Subsequent and Supplemental Environmental Impact Report in its decision-making process. SECTION 7. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: ~M.~ ROBERT M.
