RESOLUTION NO. 7903(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA FINDING THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE THE CONSTRUCTION OF STREET-
LIGHTING AND ORDERING WORK ON 24TH STREET FROM
PICO BOULEVARD TO PEARL STREET, FRANKLIN FROM
NORTHERLY CITY LIMITS TO CITY RESERVOIRS,
ASHLAND AVENUE FROM 4TH STREET TO 6TH STREET,
15TH STREET FROM BROADWAY TO COLORADO AVENUE,
HARVARD STREET FROM MONTANA AVENUE TO WILSHIRE
BOULEVARD, DELAWARE AVENUE FROM STEWART STREET
TO WARWICK AVENUE, PINE STREET FROM LINCOLN BOULEVARD
TO 7TH STREET, AND 10TH STREET AT ASHLAND AVENUE AS
SET FORTH IN RESOLUTION OF INTENTION NUMBER 7872

WHEREAS, the City of Santa Monica, on the 8th day of August
1989, passed and adopted its Resolution of Intention, being
Resolution No. 7872 (CCS), declaring its intention to order the
work described therein to be done, which Resolution of Intention
duly and legally was published as required by law and notice of
said improvement has been given in the manner required by law and
all written objections and protests to the proposed work or the
extent of the district to be assessed where heard and considered
by the City Council; and
WHEREAS, a public hearing has been held duly and regularly
pursuant to Resolution No. 7872 (CCS) and the laws and
Constitution of the state of California on the proposed
construction of street lighting and appurtenant work thereto, as
described in the Resolution No. 7872 (CCS), on:
24th street from pico Boulevard to Pearl street;
Franklin from Northerly city limits to City reservoirs;
Ashland Avenue from 4th street to 6th street~
15th street from Broadway to Colorado Avenue;
Harvard street from Montana Avenue to wilshire Boulevard~
Delaware Avenue from stewart street to warwiCk Avenue;

Pine street from Lincoln Boulevard to 7th street; and
lOth street at Ashland Avenue,
all within the city of Santa Monica.
WHEREAS, said improvement has been considered fully,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. The public interest and convenience require, and
the city Council of the City of Santa Monica hereby orders, the
work described in Resolution No. 7872 (CCS) to be done on:
24th Street from pico Boulevard to Pearl street;
Franklin from Northerly city limits to city reservoirs;
Ashland Avenue from 4th Street to 6th Street;
15th street from Broadway to Colorado Avenue;
Harvard Street from Montana Avenue to Wilshire Boulevard;
Delaware Avenue from Stewart street to warwick Avenue;
pine Street from Lincoln Boulevard to 7th street; and
lOth street at Ashland Avenue,
all within the city of Santa Monica.
Any and all of said protests and objections of every kind and
nature to the proposed work or to the extent of the district to
be assessed be, and the same hereby are, overruled and denied.
SECTION 2 .
The ci ty Council hereby finds and determines
further that "Special Assessment Investigation, Limitation, and
Majority Protest Act of 193111 shall not apply to the making of
said improvement.
SECTION 3.
The improvements shall be conducted under the
Improvement Act of 1911, which is Division 7 of the streets and
Highway Code of the state of California, and the Street

Superintendent and the City Attorney presented to the said City
Council the Resolution of Intention required by said Improvement
Act to initiate the proceedings for said improvement.
SECTION 4 .
The ci ty Clerk hereby is directed to post a
notice for five days on or near the door of the City Council
Chambers of the city Hall inviting sealed proposals or bids for
doing the work ordered and referring to the specifications on
file and to publish a notice inviting such proposals for two days
in The Outlook, a newspaper published and circulated in said
City.
SECTION 5. Reference hereby is made to Resolution No. 7872
(CCS) for a description of the work, the assessment district, the
bonds to be issued, and for further particulars.
SECTION 6. The city Clerk shall certify to the adoption of
this ReSOlution, and thenceforth and thereafter the same shall be
in full force and effect.
