A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AUTHORIZING $100 REBATES TO BE
GIVEN TO RESIDENTIAL PROPERTY OWNERS WHO
REPLACE EXISTING TOILETS AND SHOWERHEADS WITH
ULTRA LOW FLOW TOILETS AND LOW FLOW
SHOWERHEADS
WHEREAS, Section 7200A of the Santa Monica Municipal Code
provides that the City Council may authorize a Residential Fixture
Rebate Program by resolution; and
WHEREAS, the proposed rebate of One Hundred Dollars
($100) per bathroom is an essential component for successfully
implementing a plumbing fixture retrofit program; and
WHEREAS, the proposed rebate represents a strong
incentive to elicit the voluntary replacement of inefficient
plumbing fixtures,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Effective immediately, all residential water
customers and/or property owners will be eligible for a One Hundred
Dollar ($100) rebate per bathroom upon retro-fitting their existing
plumbing fixtures with "approved" models of ultra low flow toilets
(maximum of 1.6 gallons per flush) and low flow showerheads
(maximum of 3 gallons per minute). A property owner who is not
responsible for the water account will be eligible for rebates.
A water customer who is not the owner of the property is eligible
for rebates, providing that the applicant has received written

authoriziation to perform the retrofit from the owner of the
property.
SECTION 2 .
An ultra low flow toilet is considered
"approved" and therefore eligible for a rebate if it has been
certified and approved by the City of Los Angeles, Mechanical
Testing Laboratories, state Department of Housing, community
Development and either the International Association of Plumbing
and Mechanical Officials or the American National standards
Institute.
SECTION 3. Upon verification that a bathroom on the
property has been retrofitted with an approved ultra low flow
toilet and a low flow showerhead, the applicant will receive a One
Hundred Dollar ($100) rebate check from the city.
SECTION 4. There is no limit set forth for the number
of rebates which one person can receive.
SECTION 5. The fixtures must be installed in a property
located in Santa Monica. Rebates will only be offered where
eXlsting fixtures have been replaced. Any new construction or
remodel project requiring a plumbing permit for the replacement of
an existing toilet or the addition of a new toilet will not be
eligible for a rebate.
SECTION 6. No person who has been granted a rebate
because of the installation of any water conservation device shall
remove the device without first notifying the City of such removal.
In the event of such removal, the City may require reimbursement
in an amount equal to the rebate to be charged to the custormerrs
water bill.

SECTION 7. The City Clerk shall certify to the adoption
of this Resolution, and thenceforth and thereafter the same shall
be in full force and effect.
