RESOLUTION NO. 8083 (CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA APPROVING A FREEWAY AGREEMENT
WITH THE STATE OF CALIFORNIA WHICH PROVIDES FOR THE
CONSTRUCTION OF THE FOURTH STREET EASTBOUND ON-RAMP
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS
FOLLOWS:
SECTION 1. The Freeway Agreement submitted by the State of
California covering 07-LA-l, Palisades Beach Road to Route 10,
including the Fourth Street On-Ramp, and 07-LA-10, Route 1 to
Centinela Avenue, whiCh Freeway Agreement supersedes that Freeway
Agreement dated August 10, 1976, is hereby approved and the City
Manager is authorized to execute the same on behalf of the city of
Santa Monica.
SECTION 2. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be
in full force and effect.

FREEWAY AGREEMENT
THE AGREEMENT, made and entered lnto on
day of
19 ,by and between the STATE OF CALIFORNIA,
and actlng by and through the Department of Transportatlon (hereln
referred to as "STATE"I, and the Clty of Santa Monlca (hereln
referred to as "CITY").
WITNESSETH
WHEREAS, the hlghways descrlbed above have been declared to be
freeways by Resolutlons of the Callforn~a H~ghway Comm~ss~on on
November IS, 1956. and October 25, 1960; and
WHEREAS, the STATE and CITY have entered lnto a Freeway
Agreement dated August 10, 1976, relatlng to those portlons of State
Hlghway Routes 1 and 10 from Pallsades Beachroad to the Santa
Monlca Clty llmlt at Centlnela Avenue; and
WHEREAS, a revlsed plan map for such freeway has been
prepared showlng the proposed plan of the STATE as It affects
streets of the CITY; and
WHEREAS, It lS the mutual deSlre of the partles hereto to enter
lnto a new Freeway Agreement 1n accordance wlth the revlsed plan of
sald freeway.

Now, THEREFORE, IT IS AGREED:
1. Thls Agreement supersedes ln ltS entlrely sald Freeway
Agreement dated August 10, 1976.
2. Clty agrees and consents to the closlng of CITY streets,
relocatlon of CITY streets, constructlon of frontage roads and other
local roads, and other constructlon affectlng CITY streets, all as
shown on sald plan map attached hereto ~arked Exhlblt A, and made
a part hereof by thlS reference.
3. STATE shall, ln constructlon of the freeway, make such
changes affectlng CITY streets ln accordance wlth the plan map
attached hereto marked Exhlblt A.
4. STATE agrees to acqulre all necessary rlght-of-way as may
be requlred for constructlon, reconstrucllon, or alteration of CITY
streets, frontage roads, and other local roads, and CITY hereby
authorlzes STATE to acqulre ln ltS behalf all such necessary rlght-
of-way.
5. It lS understood between the parlles that the rlght-of-way
may be acqulred In sectlons or unlts, and that both as to the
acqulsltlon of rlght-of-way and the construction of the freeway
proJects, the obllgatlons of STATE hereunder shall be carr led out
at such tlme and for such unlt or unlts of the proJect as funds are
budgeted and made lawfully avallable for such expendltures.
6. CITY wlll accept control and malntenance over each of the
relocated or reconstructed CITY streets, and the frontage roads, and

other STATE constructed local roads on rece~pt of wrltten notice to
CITY and STATE that the work thereon has been completed. except for
any portlon WhlCh ~s adopted by STATE as a part of the freeway
proper. CITY wlll also accept tltle to the port~on of such roads
lying outs~de the freeway llmits, upon relinqulshment by STATE.
7. Thls Agreement may be modlfled at any tlme by the mutual
consent of the partles hereto. as may become necessary for the best
accompllshment. through STATE and CITY cooperatlon, of the whole
freeway proJect for the beneflt of the people of the STATE and of
the CITY.
IN WITNESS WHEREOF. the partles hereto have caused thlS
Agreement to be executed by thelr respectlve duly author~zed offlcers.
