City Council Meeting February 20, 1990 Santa Monica, California RESOLUTION NUMBER 7982(CCS) (City council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA APPROVING APPLICATION FOR STATE FUNDS UNDER THE COUNTY CORRECTIONAL FACILITY CAPITAL EXPENDITURE AND YOUTH FACILITY BOND ACT AND THE YOUTH CENTER AND YOUTH SHELTER BOND ACT OF 1988 WHEREAS, the people of the State of California have approved the County Correctional Facility Capital Expenditure and Youth Facility Bond Act of 1988, And The Youth Center and Youth Shelter Bond Act of 1988, which provides funds to public and private nonprofit agencies for the purpose of acquiring, renovating or constructing youth centers and youth shelters and purchasing equipment for such facilities; and WHEREAS, the Department of the Youth Authority has been delegated the responsibility for the administration of the program, setting up necessary procedures governing applications by public and nonprofit groups under the program; and WHEREAS, said procedures established by the Department of the Youth Authority require the applicant(s) to prepare a resolution approving the application and affirming the commitment of the body to meet several statutory and/or regulatory requirements; and WHEREAS, the City Council of the City of Santa Monica (hereinafter the "City") is authorized to apply to the Department of the Youth Authority for funding under the County Correctional Facility Capital Expenditure and Youth Facility Bond Act of 1988 . . and The Youth Center and Youth Shelter Bond Act of 1988; and WHEREAS, the city of Santa Monica, a local public agency organized under the Constitution and statutes of the State of California, is eligible to receive funds, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The city of santa Monica approves the filing of an application for funding under the county Correctional Facility Capital Expenditure and Youth Facility Bond Act of 1988 and The Youth Center and Youth Shelter Bond Act of 1988 (hereinafter "the Acts") . SECTION 2. The City of Santa Monica certifies to use any facility funded by the Acts for the amount of time required by section 2011 of the Welfare and Institutions Code. SECTION 3. The City of Santa Monica certif ies to use any facility to deliver programs, including, where appropriate, innovative nontraditional programs designed to meet the needs of the youth in the targeted community. SECTION 4. The City of Santa Monica certifies to use the Santa Monica Police Activities League (PAL) Board of Directors, which reflects a broad representation of the community, to be the separate mechanism to receive and consider feedback and suggestions from the community served. SECTION 5. The city of Santa Monica certifies to comply with all applicable statutes and regulations. SECTION 6. The city of Santa Monica certifies that any facility will be operated wholly within the State of California. SECTION 7. The city of Santa Monica certifies not to use any . . facility funded by the Acts for sectarian instruction or as a place of worship. SECTION 8. The city of Santa Monica certifies that any facility or that portion of a youth center that is funded under the Acts as a youth center is to provide programs and services for young people only. SECTION 9. The city Manager or an authorized designee is hereby authorized to conduct all negotiations, execute and submit all documents including, but not limited to, applications, agreements, amendments, payment requests, and reports, which may be necessary for completion of the aforementioned project. SECTION 10. The city Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM: ~wo.~ ROBERT M.
