RESOLUTION NO. ~675(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-44)
WHEREAS, the Street Superintendent of the City of Santa
Mo n i C a , pursuant to Sectlon 5600 to 5630 of the Streets and
Hi ghways Co de, commenced proceedings to cause the repair of
damaged sidewalks, dn veways and curbs in the City of Santa Monlca
at 1818 18th St. , 1760 18th St. , 1808 18th St. , 2010 18th St. ,
2006 18th St. , 2005 18th St., 1967 18th St., 1964 18th St. , 2009
18th St. , 1937 18th St. , 1933 18th St. , 1935 18th St. , 1914 18t h
St. , 1928 18th St. , 1927 18th St. , 1922 18th St. , and 1919 18t h
St.; and
WHEREAS, Slxty days after said order was served, the
work had not been completed by the owners or persons in possession
of the affected propertles, and the Superlntendent of Streets
caused the work to be done; and
WHEREAS, the superlntendent of Streets gave the notice
requlred by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superlntendent of Streets did file with the
Clty Councll of the City of Santa Monica his report of repalrs and
cost as requlred by Sectlon 5617 of the Streets and Highways Code;

WHEREAS~ upon the day and hour flxed for hearlng by
Resolution Number 6648 (CeS), the City Council of the City of
Santa Monlca heard and passed upon the report of the
Superlntendent of Streets together with all obJectlons and
protests as required by Sectlon 5618 of the Streets and Hlghways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore flled and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and obJections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denled.
SECTION 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets~ shall be assessed
against the propertl€S therein described, which properties front
upon the sldewalk upon WhlCh the repairs were made.
SECTION 4. That if such assessment is not paid within
the time perm1tted by law~ the same shall constitute a speclal
assessment against and lien on the properties therein described,
1n the amount set forth in the report of the Superlntendent of
Streets, which lien shall continue until the assessment and all
interest thereon lS paid or until 1t lS discharged of record.

SECTION 5. That If the asssessment is not pald within
the tlme permltted by law, the Superlntendent of Streets, in
accordance wlth Sectlon 5628 of the Streets and Highways Code,
shall del1ver a Notlce of L1en~ prepared in the manner requlred by
Section 5626 of the Streets and Highways Code, to the County
Audltor who shall collect the assessment together wlth all other
taxes against the property.
SECTION 6.
That the Clty Clerk shall certify to the
adoptlon of thlS resolutlon and thenceforth and thereafter the
same shall be in full force and effect.
