A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS~ DRIVEWAYS AND CURBS
(SR-83-46)
WHEREAS, the Street Super1ntendent of the City of Santa
Mon1ca~ pursuant to Sect10n 5600 to 5630 of the Streets and
Highways Code~ commenced proceedings to cause the repa1r of
damaged sldewalks, dr1veways and curbs in the City of Santa Monica
at 1937 to 1841 19th St., 1901 19th St., 1907 19th St., 1023 19th
St., 1925 19th St., 1927 19th St., 1943 19th St., 1957 19th St.,
1963 19th St. ~ 2001 19th St., 2023 19th St., 2009 19th St. ~ 2005
19th St., 2133 21st St., 2401 21st St., 2405 21st St., and 2135
21st St.; and
WHEREAS. Slxty days after said order was served. the
work had not been completed by the owners or persons in possess1on
of the affected propertles, and the Superlntendent of Streets
caused the work to be done; and
WHEREAS. the Superintendent of Streets gave the notice
requ1red by Sect10n 5616 of the Streets and H1ghways Code; and
WHEREAS, the Super1ntendent of Streets did f1le w1th the
City Counc1l of the C1ty of Santa Monica his report of repa1rs and
cost as required by Sect10n 5617 of the Streets and H1ghways Code;

WHEREAS. upon the day and hour f1xed for hear1ng by
Resolution Number 6674 (CCS), the C1ty Counc1l of the C1ty of
Santa Monica heard and passed upon the report of the
Super1ntendent of Streets together w1th all object1ons and
protests as requ1red by Section 5618 of the Streets and H1ghways
Code;
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore f1led and above-descr1bed be and the same is
hereby conf1rmed.
SECTION 2. That all protests and objections of every
kind and nature to the report of the Super1ntendent of Streets be
and the same are hereby overruled and den1ed.
SECTION 3. That the cost of the repairs, as set forth
in the report of the Superintendent of Streets, shall be assessed
aga1nst the propert1es therein descrlbed, WhlCh properties front
upon the sldewalk upon which the repairs were made.
SECTION 4. That if such assessment is not paid with1n
the t1me permitted by law, the same shall constitute a spec1al
assessment agalnst and 11en on the propert1es therein descr1bed,
in the amount set forth 1n the report of the Super1ntendent of
Streets, WhlCh lien shall continue untll the assessment and all
1nterest thereon lS pa1d or unt1' it ;s d1scharged of record.

SECTION 5. That 1f the asssessment is not paid withln
the tlme perm1tted by law, the Superintendent of Streets, In
accordance w1th Sectlon 5628 of the Streets and Highways Code,
shall dellver a Notlce of lien, prepared in the manner required by
Sectlon 5626 of the Streets and H1ghways Code, to the County
Aud1tor who shall collect the assessment together w1th all other
taxes aga1nst the property.
SECTION 6.
That the C1ty Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be 10 full force and effect.
