RESOLUTION NO. 6701(CC5)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-47)
WHEREAS, the Street Superintendent of the City of Santa
Mon1ca$ pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repa1r of
damaged sldewalks, dr1veways and curbs in the City of Santa Mon1ca
at 2125 21st St., 2315 21st St., 2141 21st St., 2201 21st St.,
2247 21st St.~ 2341 21st St., 2345 21st St., 2411 21st St., 2425
21st St., 2421 21st St.~ 2435 21st St., 2428 21st St., 2445 21st
St., 2422 21st St., 2432 21st St., 1428 25th St., 1424 25th St.,
2452 21st St., 2451 21st St. and 2503 21st St.; and
WHEREAS, sixty days after sa1d order was served, the
work had not been completed by the owners or persons 1n possession
of the affected propert1es, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Sect10n 5616 of the Streets and Highways Code; and
WHEREAS~ the Superintendent of Streets d1d fl1e wlth the
City Council of the C1ty of Santa Monica his report of repa1rs and
cost as requ1red by Sect10n 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour f1xed for hearing by
Resolut1on Number 6678 (CCS), the City Council of the City of
Santa Monica heard and passed upon the report of the
Superintendent of Streets together with all obJections and
protests as required by Section 5618 of the Streets and H1ghways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore f1led and above-described be and the same is
hereby confirmed.
SECTION 2. That all protests and obJections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repa1rs, as set forth
in the report of the Super1ntendent of Streets, shall be assessed
aga1nst the properties there1n described, Wh1Ch properties front
upon the sldewalk upon Wh1Ch the repairs were made.
SECTION 4. That if such assessment 1S not paid with1n
the time permltted by law, the same shall const1tute a special
asseSSment against and llen on the properties therein described,
1n the amount set forth 1n the report of the Superintendent of
Streets, WhlCh lien shall cont1nue unt1l the assessment and all
1nterest thereon 1S pald or unt1l it 1S d1scharged of record.

SECTION 5. That 1f the asssessment is not paid within
the t1me perm1tted by law, the Superintendent of Streets, in
accordance w1th Sect10n 5628 of the Streets and Highways Code,
shall del1ver a Notlce of Lien, prepared 1n the manner required by
Section 5626 of the Streets and H1ghways Code, to the County
Auditor who shall collect the assessment together with all other
taxes against the property.
SECTION 6.
That the Ci ty C1 erk sha 11 cert 1 fy to the
adoption of th1s resolut1on and thenceforth and thereafter the
same shall be ln full force and effect.
