RESOLUTION NO. 6726(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING GUTTER
CONSTRUCTION ON WILSHIRE BOULEVARD BETWEEN
OCEAN AVENUE AND TWENTY-FIRST STREET ALL
WITHIN THE CITY OF SANTA MONICA
WHEREAS, the City Councll of the City of Santa Monica,
pursuant to Section 5870 et seq. of the Streets and Highways Code,
commenced proceedings to cause the construction of concrete
gutters
on
Wllshlre
Boulevard
between
Ocean Avenue and
Twenty-first Street in the City of Santa Monica; and
WHEREAS, the Superintendent of Streets served the notice
required by Sectlon 5876 of the Streets and Highways Code and the
City Council of the City of Santa Monica held the hearing required
by Sectlon 5878.1 of the Streets and Hlghways Code; and
WHEREAS, sixty (60) days after the notlce was served,
the work had not been completed by the owners or persons in
possession of the affected properties, and the Superintendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5881 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets dld file wlth the
Clty
Council
of the Clty of Santa Monlca his report of
construction and cost as required by Section 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour fixed for hearlng by
Resolution Number 6713 (CCS) the City Council of the Clty of Santa
Monlca heard and passed upon the report of the Superintendent of

Streets together with all obJections and protests as required by
Section 5883 of the Streets and H1ghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-described be and the same is
hereby conf1rmed.
SECTION 2. That all protests and object1ons of every
kind and nature to the report of the Super1ntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the construct1on, as set
forth 1n the report of the Super1ntendent of Streets, shall be
assessed against the propert1es there1n described, which
properties front upon the gutters so constructed.
SECTION 4. That 1f such assessment is not paid with1n
the time permitted by law, the same shall constitute a spec1al
assessment against and lien on the propert1es therein described,
in the amount set forth in the report of the Super1ntendent of
Streets, which llen shall continue until the assessment and all
1nterest thereon is pa1d or unt1l lt is discharged of record.
SECTION 5. That if the assessment is not pa1d within
the t1me permltted by law, the Super1ntendent of Streets, in
accordance with Section 5893 of the Streets and H1ghways code,
shall deliver a Not1ce of Lien, prepared 1n the manner requ1red by
Sectlon 5891 of the Streets and H1ghways code, to the County
Auditor who shall collect the assessment together with all other
taxes aga1nst the property.

SECTION 6.
That the Clty Clerk shall certlfy to the
adoptlon of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
