RESOLUTION NO. 6733(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-50)
WHEREAS~ the Street Superintendent of the C1ty of Santa
Monica, pursuant to Sect10n 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repa1r of
damaged sidewalks, drlveways and curbs in the City of Santa Monlca
at 2455 California, 357 24th St., 2300 Callfornia, 2441 Ca1fornla,
2004 California, 1333 Ocean, 2450 Chelsea Pl., 1045 23rd St., 801
Idaho, 2702 Washlngton, 2471 Oak, 2462 Oa, 2470 Oak, 2561 Oak,
2449 Oak, 2453 Oak, 425 11th St. and 417 11th St.; and
WHEREAS, sixty days after said order was served, the
work had not been completed by the owners or persons in possess10n
of the affected propert1es, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Sectlon 5616 of the Streets and Highways Code; and
WHEREAS, the Superlntendent of Streets did f1le with the
City Counc11 of the C1ty of Santa Monica his report of repairs and
cost as requ1red by Sect10n 5617 of the Streets and Highways Code;

WHEREAS, upon the day and hour fixed for hearing by
Resolution Number 6718 (CCS), the City Council of the C1ty of
Sa n t a
Monlca
heard
and
passed
upon the report of the
Supen ntendent
of Streets together with all objections and
protests as requlred by Section 5618 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1.
That the report of the Super1ntendent of
Streets heretofore fl1ed and above-described be and the same is
hereby confirmed.
SECTION 2.
That all protests and objections of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as set forth
1n the report of the Super1ntendent of Streets, shall be assessed
against the properties there1n descr1bed) which properties front
upon the sidewalk upon which the repairs were made.
SECTION 4. That 1f such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment against and llen on the propert1es there1n described,
1n the amount set forth in the report of the Superintendent of
Streets, Wh1Ch llen shall cont1nue until the assessment and all
1nterest thereon is paid or unt1l 1t is discharged of record.

SECTION 5. That 1f the asssessment 1S not paid within
the t1me permitted by law, the Superintendent of Streets, in
accordance with Section 5628 of the Streets and Highways Code,
shall dellver a Not1ce of llen, prepared in the manner required by
Sect10n 5626 of the Streets and H1ghways Code, to the County
Auditor who shall collect the assessment together with all other
taxes against the property.
SECTION 6.
That the C1ty Clerk shall cert1fy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
