RESOLUTION NO. 6734(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING ALLEY
RECONSTUCTION OF FIRST COURT BETWEEN COLORADO
AND BROADWAY ALL WITHIN THE CITY OF SANTA
MONICA
WHEREAS, the C1ty Council of the C1ty of Santa Monlca,
pursuant to Sect10n 5870 et seq. of the Streets and Highways Code,
commenced
proceedings
to
cause the construction of alley
reconstruct1on of F1rst Court between Colorado and Broadway 1n the
C1ty of Santa Mon1ca; and
WHEREAS, the Super1ntendent of Streets served the notice
requ1red by Sect10n 5876 of the Streets and Highways Code and the
C1ty Councll of the Clty of Santa Monica held the hearing required
by Section 5878.1 of the Streets and Highways Code; and
WHEREAS, Slxty (60) days after the not1ce was served,
the work had not been completed by the owners or persons 1n
possess1on of the affected propert1es, and the Superintendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Sectlon 5881 of the Streets and Hlghways Code; and
WHEREAS, the Superintendent of Streets d1d f1le with the
Clty
Council
of the City of Santa Mon1ca his report of
construct1on and cost as required by Section 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour flxed for hearlng by
Resolut10n Number 6719 (CCS) the C1ty Counc1l of the City of Santa

Monica heard and passed upon the report of the Superintendent of
Streets together with all obJections and protests as required by
Sect10n 5883 of the Streets and Highways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-descr1bed be and the same is
hereby confirmed.
SECTION 2. That all protests and obJect10ns of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the reconstruction, as set
forth in the report of the Superintendent of Streets, shall be
assessed against the properties therein described, Wh1Ch
properties front upon the alley reconstruced.
SECTION 4. That if such assessment is not paid w1thin
the time permitted by law, the same shall constitute a special
assessment against and lien on the properties therein described,
1n the amount set forth in the report of the Superintendent of
Streets, Wh1Ch lien shall contlnue until the assessment and all
1nterest thereon lS pa1d or untll lt is discharged of record.
SECTION 5. That if the assessment is not paid w1thin
the t1me permitted by law, the Super1ntendent of Streets~ in
accordance w1th Sect10n 5893 of the Streets and Highways code,
shall deliver a Notice of lien~ prepared 1n the manner requ1red by
Sectlon 5891 of the Streets and H1ghways code, to the County

Auditor who shall collect the assessment together w1th all other
taxes against the property.
SECTION 6.
That the C1ty Clerk shall certify to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
