RESOLUTION NO. 6748(CC5)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING STREET
LIGHT INSTALLATION ON 25TH STREET BETWEEN
PEARL AND OCEAN PARK, EUCLID BETWEEN GEORGINA
AND BRENTWOOD TERRACE, BERKELEY BETWEEN
STANFORD AND WILSHIRE AND 12TH STREET BETWEEN
MARGUERITA AND ALTA, ALL WITHIN THE CITY OF
SANTA MONICA
WHEREAS, the C1ty Council of the C1ty of Santa Monica,
pursuant to Section 5870 et seq. of the Streets and H1ghways Code,
commenced proceed1ngs to cause the installation of street lights
on 25th Street between Pearl and Ocean Park, Eucl1d between
Georgina and Brentwood Terrace, Berkeley between Stanford and
Wilshire and 12th Street between Marguerita and Alta in the Clty
of Santa Monlca; and
WHEREAS, the Superintendent of Streets served the notice
required by Section 5876 of the Streets and Highways Code and the
City Counc1l of the City of Santa Monica held the hear1ng required
by Sect10n 5878.1 of the Streets and Highways Code; and
WHEREAS, Slxty (60) days after the notice was served,
the work had not been completed by the owners or persons in
possession of the affected properties, and the Superintendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the not1ce
requ1red by Section 5881 of the Streets and H1ghways Code; and
WHEREAS, the Superintendent of Streets d1d f11e with the
City

construct1on and cost as required by Sectlon 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour f1xed for hearing by
Resolutlon Number 6731 (CCS) the City Council of the C1ty of Santa
Monica heard and passed upon the report of the Super1ntendent of
Streets together with all obJect1ons and protests as required by
Sectlon 5883 of the Streets and H1ghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA

MONICA DOES RESOLVE AS FOLLOWS:
SECT ION 1.
That the report of the Super1ntendent of
Streets heretofore filed and above-descr1bed be and the same lS
hereby confirmed.
SECTION 2.
That all protests and object1ons of every
klnd and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3.
That the cost of the construction, as set
forth 1n the report of the Super1ntendent of Streets, shall be
assessed
against
the
propert1es
therein described, which
propertles front upon the street lights so constructed.
SECTION 4.
That if such assessment 1S not paid within
the tlme perm1tted by law, the same shall constitute a special
assessment agalnst and 11en on the propert1es therein descr1bed,
in the amount set forth in the report of the Superintendent of
Streets, Wh1Ch lien shall cont1nue until the assessment and all
interest thereon 1S pa1d or until it 1S discharged of record.
SECTION 5.
That if the assessment is not pa1d w1thin
the time permitted by law, the Super1ntendent of Streets, in

accordance wlth Section 5893 of the Streets and H1ghways Code,
shall deliver a Notice of L1en, prepared ln the manner required by
Sect10n 5891 of the Streets and H1ghways Code, to the County
Aud1tor who shall collect the assessment together with all other
taxes against the property.
SECTION 6. That the City Clerk shall certlfy to the
adopt1on of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
