RESOLUTION NO. 6749(CCS)
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-83-49)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and
Highways Codes commenced proceedlngs to cause the repair of
damaged sldewalkss driveways and curbs in the City of Santa Monica
at 2455 California, 357 24th St., 2300 California, 2441 Calfornlas
2004 Callfornia, 1333 Ocean, 2450 Chelsea Pl., 1045 23rd St., 801
Idahos 2702 Washingtons 2471 Oak, 2462 Oak, 2470 Oak, 2561 Oaks
2449 Oak, 2453 Oak, 425 11th St. and 417 11th St.; and
WHEREAS, SIxty days after said order was served, the
work had not been completed by the owners or persons in possesslon
of the affected propertles, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superlntendent of Streets did flle with the
Clty Councll of the City of Santa Monlca his report of repairs and
cost as requlred by Sectlon 5617 of the Streets and Highways Code;
and

WHEREAS, upon the day and our flxed for hearlng by
Resolutlon Number 6732 (CCS), the Ci y Council of the Clty of
Santa Monlca heard and passed pan the report of the
Superintendent of Streets together ith all obJections and
protests as required by Sectlon 5618 0 the Streets and Hlghways
Code;
NOW, THEREFORE, THE CITY cau CIl OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOllOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore flled and above-des rlbed be and the same is
hereby confirmed.
SECTION 2. That all protest and objections of every
kind and nature to the report of the Su erlntendent of Streets be
and the same are hereby overruled and de ied.
SECTION 3. That the cost of the repairs, as set forth
1n the report of the Super1ntendent of treets, shall be assessed
agalnst the properties therein descrlb d, which properties front
upon the sidewalk upon which the repalrs were made.
SECTION 4. That if such ass ssment is not paid within
the time permitted by law, the same hall constitute a specla1
assessment agalnst and lien on the pro erties therein described,
in the amount set forth 1n the repor of the Superintendent of
Streets, WhlCh llen shall contlnue unt 1 the assessment and all
interest thereon is pald or unt11 it is lscharged of record.

SECTION 5. That 1f the asss ssment 1S not pa1d within
the time permitted by law, the Supe intendent of Streets, in
accordance with Section 5628 of the
treets and Highways Code,
shall deliver a Notlce of Lien, prepared 1n the manner required by
Sect10n 5626 of the Streets and H1g ways Code, to the County
Audltor who shall collect the assessme t together wlth all other
taxes against the property.
SECTION 6.
That the City C erk shall certify to the
adopt1on of this resolution and thenc forth and thereafter the
same shall be 1n full force and effect.
