RESOLUTION NO. 6591(CC5)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-82-37)
WHEREAS, the Street Superlntendent of the City of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and
Hlghways Code, commenced proceedlngs to cause the repalr of
damaged sldewalks, drlveways and curbs in the City of Santa Monica
at 911 Marlne, 1211 Marine, 1205 Marlne, 1109 Marine, 1105 Marlne,
1214 Marlne, 1106 Marlne, 1002 Marlne, 1219 Marine, 1306 Marine,
1311 Marine, 1224 Marlne, 1314 Marlne, 1307 Marlne and 909 Marlne;
and
WHEREAS. sixty days after sald order was served, the
work had not been completed by the owners or persons in possesslon
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notice
requlred by Sectlon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superintendent of Streets dld file with the
City Council of the City of Santa Monlca hlS report of repairs and
cost as requlred by Sectlon 5617 of the Streets and Hlghways Code;
and

WHEREAS, upon the day and hour flxed for hearing by
Resolutlon Number 6576 (CCS). the Clty Councll of the City of
Santa Monica heard and passed upon the report of the
SuperIntendent of Streets together with all objections and
protests as required by Sectlon 5618 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore flled and above-descrlbed be and the same is
hereby conflrmed.
SECTION 2. That all protests and obJections of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repalrs, as set forth
Tn the report of the Superintendent of Streets, shall be assessed
against the properties thereln descrlbed, WhlCh propertles front
upon the sldewalk upon WhlCh the repalrs were made.
SECTION 4. That lf such assessment 1S not paid wlthin
the time permltted by law, the same shall constltute a special
assessment agalnst and llen on the properties therein described,
in the amount set forth 1n the report of the Superlntendent of
Streets, which llen shall continue unt11 the assessment and all
interest thereon is paid or until it is dlscharged of record.

SECTION 5. That if the asssessment 15 not paid w1thin
the t1me perm1tted by law, the Superintendent of Streets, 1n
accordance w1th Section 5628 of the Streets and Hlghways Code,
shall del1ver a Notlce of L1en, prepared in the manner requlred by
Section 5626 of the Streets and Highways Code, to the County
Audltor who shall collect the assessment together with all other
taxes aga1nst the property.
SECTION 6.
That the City Clerk shall certlfy to the
adopt1on of this resolutlon and thenceforth and thereafter the
same shall be 1n full force and effect.
