RESOLUTION NO. 6600(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS. DRIVEWAYS AND CURBS
(SR-82-38)
WHEREAS~ the Street Superintendent of the City of Santa
Monica, pursuant to Section 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sldewalks. driveways and curbs In the Clty of Santa Monlca
at 135 San Vlcente, 3043 Linda Lane, 1610 Marine, 1612 Marine,
1621 Marine, 1615 Marlne, 1607 Marlne, 441 24th Street, 1435
Marine, 1663 Ocean Avenue, 1717 Ocean Avenue and 1711 Ocean
Avenue; and
WHEREAS, sixty days after Sdld order was served, the
work had not been completed by the owners or persons in possession
of the affected properties, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
requlred by Sectlon 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets dld flle wlth the
Clty Council of the Clty of Santa Monica his report of repalrs and
cost as required by Section 5617 of the Streets and Hlghways Code;

WHEREAS~ upon the day and hour flxed for hearing by
Resolutlon Number 6583 (CCS)~ the City Council of the Clty of
Santa Monica heard and passed upon the report of the
Superintendent of Streets together with all obJect1ons and
protests as required by Sect10n 5618 of the Streets and Highways
Code;
NOW~ THEREFORE~ THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-descr1bed be and the same is
hereby confirmed.
SECTION 2. That all protests and obJectlons of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs~ as set forth
1n the report of the Superlntendent of Streets, shall be assessed
against the propertles thereln descrlbed, WhlCh propertles front
upon the sldewalk upon which the repairs were made.
SECTION 4. That lf such assessment 15 not pa1d within
the tlme permitted by law, the same shall constitute a special
assessment against and lien on the propertles thereln described,
in the amount set forth in the report of the Superlntendent of
Streets, which lien shall continue until the assessment and all
interest thereon is paid or untll 1t lS discharged of record.

SECTION 5. That if the asssessment is not paid within
the time permltted by law, the Superintendent of Streets, in
accordance wlth Section 5628 of the Streets and Highways Code,
shall deliver a Notlce of Lien, prepared in the manner requlred by
Section 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6. That the Clty Clerk shall certify to the
adoptlon of thlS resolutlon and thenceforth and thereafter the
same shall be in full force and effect.
