RESOLUTION NO. 6601(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING GUTTER
INSTALLATION ON FOURTH STREET BETWEEN BROADWAY
AND ARIZONA AVENUE, ALL WITHIN THE CITY OF
SANTA MONICA
WHEREASt the C1ty Counc1l of the City of Santa Mon1cat
pursuant to Section 5870 et seq. of the Streets and Highways Code~
commenced proceed1ngs to cause the construction of concrete
gutters on Fourth Street between Broadway and Ar1zona Avenue 1n
the Clty of Santa Mon1ca; and
WHEREAS, the Super1ntendent of Streets served the notlce
requ1red by Sectlon 5876 of the Streets and Hlghways Code and the
C1ty Counc11 of the City of Santa Mon1ca held the hearing requ1red
by Section 5878.1 of the Streets and H1ghways Code; and
WHEREAS, Slxty (60) days after the notice was served,
the work had not been completed by the owners or persons in
posseSSlon of the affected properties, and the Superlntendent of
Streets caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
requlred by Section 5881 of the Streets and Highways Code; and
WHEREAS. the Superlntendent of Streets did flle with the
Clty
Councll
of the Clty of Santa Monica hlS report of
constructlon and cost as requlred by Section 5882 of the Streets
and Highways Code; and
WHEREAS, upon the day and hour fixed for hearing by
Resolutlon Number 6582 (CCS) the C,ty Council of the City of Santa
Monica heard and passed upon the report of the Superintendent of

Streets together with all obJectlons and protests as required by
Section 5883 of the Streets and Hlghways Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superlntendent of
Streets heretofore filed and above-described be and the same is
hereby conflrmed.
SECTION 2. That all protests and obJect10ns of every
klnd and nature to the report of the Super1ntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the construction, as set
forth in the report of the Superintendent of Streets, shall be
assessed agalnst the properties therein described, which
properties front upon the gutters so constructed.
SECTION 4. That if such assessment 1S not pa1d w1th1n
the time permitted by law, the same shall constitute a special
assessment agalnst and lien on the propertles therel" descr1bed,
in the amount set forth in the report of the Superintendent of
Streets, WhlCh lien shall continue until the assessment and all
interest thereon is pald or untll lt 15 dlscharged of record.
SECTION 5. That if the assessment is not pa1d w1thln
the time permltted by law, the Superlntendent of Streets, in
accordance wlth Sectln 5893 of the Streets and Highways code,
shall dellver a Notlce of Llen, prepared In the manner requlred by
Sectlon 5891 of the Streets and Hlghways code, to the County
Audltor who shall collect the assessment together with all other
taxes agalnst the property.

SECTION 6.
That the Clty Clerk shall certlfy to the
adoptlon of thls resolutlon and thenceforth and thereafter the
same shall be In full force and effect.
