A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-82-39)
WHEREAS, the Street Superlntendent of the City of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and
Highways Code, commenced proceedings to cause the repair of
damaged sldewalks, driveways and curbs in the Clty of Santa Monlca
at 2142 21st Street, 830 Yale, 2202 21st Street, 2212 21st Street,
2228 21st Street, 2232 21st Street, 2210 21st Street, 824 Yale
Street, 842 Yale Street, 507 Llncoln Boulevard, 2242 21st Street
and 2236 21st Street, and
WHEREAS, sixty days after sa1d order was served, the
work had not been completed by the owners or persons in possesslon
of the affected propert1es, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlce
required by Section 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superintendent of Streets did flle wlth the
Clty Councll of the Clty of Santa Monlca his report of repairs and
cost as required by Sectlon 5617 of the Streets and Hlghways Code;

WHEREAS. upon the day and hour f1xed for hearing by
Resolut1on Number 6597 (CCS). the C1ty Council of the C1ty of
Santa Monica heard and passed upon the report of the
Superlntendent of Streets together wlth all obJections and
protests as required by Sect10n 5618 of the Streets and H1ghways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore filed and above-descrlbed be and the same is
hereby confirmed.
SECTION 2. That all protests and objections of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denled.
SECTION 3. That the cost of the repairs, as set forth
1n the report of the Superlntendent of Streets, shall be assessed
agalnst the propert1es thereln descrlbed, WhlCh propert1es front
upon the sldewalk upon Wh1Ch the repa1rs were made.
SECTION 4. That lf such assessment 1S not paid w1th1n
the t1me perm1tted by law. the same shall const1tute a special
assessment aga1nst and llen on the properties thereln described,
1n the amount set forth 1n the report of the Super1ntendent af
Streets, Wh1Ch l1en shall cont1nue untll the assessment and all
interest thereon 1S pa1d or untll it is dlscharged of record.

SECTION 5. That if the asssessment is not paid wlthin
the t1me perm1tted by law, the Superlntendent of Streets, 1n
accordance with Sectlon 5628 of the Streets and Hlghways Code,
shall dellver a Notlce of Llen, prepared in the manner requlred by
Sectlon 5626 of the Streets and H1ghways Code, to the County
Aud1tor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the Clty Clerk shall certlfy to the
adoptlon of thlS resolution and thenceforth and thereafter the
same shall be 1n full force and effect.
