A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REMOVAL
AND REPAIRS OF ABANDONED DRIVEWAYS (AD-i)

WHEREAS, the Street Superintendent of the Clty of Santa
pursuant to Munlcipal Code Sectlons 7402 to 7406.
commenced proceedlngs to cause the removal and repair of abandoned
driveways in the City of Santa Monica at 170 Pier Avenue, 1414 6th
Street and 702 Wilshlre Boulevard; and
WHEREAS. twenty days after said order was served. the
work had not been completed by the owners or persons 1n possession
of the affected propert1es, and the Superintendent of Streets
caused the work to be done; and
WHEREAS. the Super1ntendent of Streets gave the notice
requ1red by Mun1clpal Code Section 7407; and
WHEREAS, the Superlntendent of Streets did f1le with the
City Council of the City of Santa Monica hlS report of repa1rs and
cost as requlred by Municipal Code Section 7408; and
WHEREAS. upon the day and hour fixed for hearing by
Resolutlon Number 6602 (CCS). the Clty Councll of the Clty of
Santa
Monlca
heard
and
passed
upon the report of the
Super1ntendent
of Streets together with all obJect1ons and
protests as requlred by Munic1pal Code Sectlen 7409;

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1.
That the report of the Superlntendent of
Streets heretofore filed and above-described be and the same is
hereby conflrmed.
SECTION 2.
That all protests and objections of every
kind and nature to the report of the Superintendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the removal and repalr, as
set forth 1n the report of the Superintendent of Streets, shall be
assessed
against
the
propertles
thereln described, which
propertles front upon the drlveway upon Wh1Ch the repairs were
made.
SECTION 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment against and lien on the properties therein described,
ln the amount set forth in the report of the Superintendent of
Streets, which lien shall contlnue until the assessment and all
interest thereon 1S paid or until lt lS discharged of record.
SECTION 5. That if the asssessment 1S not paid w1thln
the time permltted by law, the Superintendent of Streets, ln
accordance wlth Munlclpal Code Sectlon 7410, shall dellver a
Notlce of L1en, prepared in the manner requlred by Municipal Code
Sectlon 7411, to the County Audltor who shall collect the
assessment together with all other taxes against the property.

SECTION 6.
That the Clty Clerk shall certify to the
adoptlon of thlS resolutlon and thenceforth and thereafter the
same shall be in full force and effect.
