RESOLUTION OF TnE CITY vOUN~IL OF THE CITY OF
SA~TA MONICA APPROVING THE APPLICATION FOR
GRA~T FUNDS UN~ER THE ~OBERTI-ZTBERG URBAN OPEN
SPAv2 AND RE~REATION PBOGPAM FOR STEWART STREST
PARK.
WHE?EAS, the legIslature of the State of CalIfornIa has enacted
the Rober~l-Z'Berg Urban Open-Space and RecreatIon Program, WhICh provIdes
funds to certaIn polItIcal subdIVISIons of the State of ~allfornla for acqulrlng
lands and for developIng facllltles to ~eet urban recreat10n needs; and
WdER2AS, the State Department of Parks and RecreatIon has been
delegated the responSIbIlIty for the ad~lnlstratlon of the prograM, settIng
up necessary procedures governIng appllcatlon by local agenCIes under the
program; ar:d
WHEREAS, saId procedures establIshed by the State Department
of Parks and RecreatIon reqUIre the ap~llcant to certIfy by resolutIon the
approval of applIcatIons prIor to submlsSlor: of saId applIcatIons to the
state; and
vlliEREAS, saId applIcatIons contaIn a certIf1catIon that the
applIcant WIll corrply WIth all federal, sta~e, and local envIronmental,
publIC health, relocatIon, affIrmatIve actIon, and clearInghouse requlremeI'ts
and all other approprIate codes, laws and regulatIons prIor to the expendIture
of the grant funds; and
WHEREAS, Stewart Street Park 18 of a hIgh prIorIty and satlsfles
the most urgent park and recreatlo~ needs WIth e~phaslS on un~et needs In
the most heaVIly populated areas,
NOW, THEREFORE, THE ~=TY ~OJN~IL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1. Approves the f~l~ng of an applIcat~on for fund~ng
under the Robertl-Z'Berg Urban Open Space and RecreatIon Program for Stewart
Street Park.
SE~TION 2. ~ertIfIes that sa~d agency understands the general
proV~Slons of the agreement.
SE~TION 3. ~ertIfles that sa~d agency has or wIll have suffICIent
funds to operate and ~a~ntaIn Stewart Street Park as funded under thIS program.
SS~T=ON 4. CertIfIes that sa~d agency has or WIll have
ava~lable prIor to cow~encement of any work on Stewart Street Park matchIrg
~oney frc~ a nonstate source.
SE~?ION 5. CertIfIes ~tat Stewart Street Park conforms to the
recreat~on element of the CIty general olano
SE~YION 6. AppOInts the ~~ty Manager as agent of the vlty of
Santa MonIca to conduct all negot~atlons, execute and submlt all docuwents
IncludIng but not lImIted to appllcat1ons, agreements, a~endments, payment
requests and so on WhICh May be necessary for the completIon of the aforementIoned
~roJ ec t ( s ) .
SE~TIOK 7. AppOInts the ~~ty Attorney as legal counsel for
sa~d agency wlth authorIzat~on to s~gn the certIfIcatIon on page 1 of appllcatlon.
SE~TION 8. The (~ty Clerk shall certIfy to the adoptIon of
thIS resolutlon, apd thenceforth and thereafter the same shall be ~n full
force and effect.
