R-6621 e It CA:RMM:r City Council Meeting 2-1-83 Santa Monica, California RESOLUT ION NUMBER 6621 (CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA RATIFYING, CONFIRMING, AND APPROVING THE PROCLAMATION OF LOCAL EMERGENCY ISSUED BY THE DIRECTOR OF EMERGENCY SERVICES AND THE RULES, REGULATIONS, AND ACTIONS TAKEN PURSUANT THERETO WHEREAS, Municipal Code Section 2305 authorizes the Director of Emergency Services to proclaim the existence or threatened existence of a local emergency when the City of Santa Monica is affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, commencing at 12:01 a.m. on January 27, 1983, conditions of extreme peril to the safety of persons and property have arisen within the City of Santa Monica caused by storm, high tides, and heavy surf: and WHEREAS, the City Council was not in session on January 27, 1983: and WHEREAS, on January 27, 1983, the Director of Emergency Services of the City of Santa Monica did proclaim the existence of a local emergency within the City of Santa Monica; and WHEREAS, pursuant to Municipal Code Section 2305, the Director of Emergency Services has made and issued rules and 1 e e regulations reasonably related to the protection of life and property as affected by such emergency, NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Council of the City of Santa Monica ratifies, confirms, and approves the proclamation of local emergency by the Director of Emergency Services and the rules, regulations, and actions taken pursuant thereto. Specifically, the City Council of the City of Santa Monica ratifies, confirms, and approves: Emergency Proclamation. Resolution Proclaiming Existence of Local Emergency. Emergency Proclamation Implementation Order Number 1 . Emergency Proclamation Implementation Order Number 2. Emergency Proclamation Implementation Order Number 3. Emergency Proclamation Implementation Order Number 4. Emergency Proclamation Implementation Order Number S. Emergency Proclamation Implementation Order Number 6. (A true and correct copy of each of these documents is attached hereto marked Exhibit A.) SECTION 2. The local emergency as proclaimed by the Director of Emergency Services shall be deemed to continue to exist in the City of Santa Monica until its termination is proclaimed by the City Council of the City of Santa Monica. SECTION 3. A copy of this resolution shall be forwarded to the State Director of the Office of Emergency Services with a request that he find it acceptable in accordance with the 2 e e provJ.sions of the Natural Disaster Assistance Act. The authorized respresentative of the City of Santa Monica for the purpose of receipt, processing, and coordination of all inquiries and requirements necessary to obtain available state assistance is: John H. A recent storm has caused maJor and widespread damage 1n the City of Santa Monlca, destroYlng portions of the Santa Monica PIer, and threatenting other portions of the pler. In addition, substantial storm damage has left debris on Santa Monica Beach and the bluffs along Pacific Coast Hlghway have also been damaged. The Santa Mon~ca Pier has been closed. The pier will remain closed until the risk of storm damage has abated, and the City determines that no extraordinary risk of damage to the Pier or of personal injury is likely to occur. 2. No person shall enter Santa Monica pier unless authorized by the Director of Emergency Services or by this Order. 3. Santa Monica Beach south of the Pier to the south city limits is hereby closed. No person shall enter this portion of the Santa Monica Beach except emergency crews of the State, County, or local government. 4. Lessees will be allowed to remove perishable items, bookkeeping, and monies from thelr businesses from 1:30 p.m. to 4:00 p.m., January 27, 1983, as directed by the pier Manager. A maximum of three persons per business are allowed. Lessees must provide identification to Police Personnel at the Pier entrance. Vehicles may be parked only at the entrance to the Pier parking lot. All persons must immediately check into the Pier Office for directlons after parking their vehicles. 5. Entrance to the Pier is made at the risk of the person seeking access. The City wlll not permit any access to leased premises unless the person first agrees to release the City from any liability for damages and signs an agreement to that effect at the time of check-in. City personnel wlll assist in the removal of personal property. In order to assure public safety and efficient removal procedures, all directions of the pier Manager shall be followed. 6. Electricity for the Pier has been shut off since 9:00 a.m. and will remain shut off until further notice. 7. Any violation of these Rules and Regulations shall be a violation of Santa Monica Municipal Code Section 2309. Questions can be directed to the City Manager's Office, 393-9975 extension 301. Santa Monica Beach north of the Pier for a distance of 400 feet north of the pier is hereby closed. No person shall enter this portion of the Santa Monica Beach except emergency crews of the State, County, or local government. 2. Any violation of these Rules and Regulations shall be a violation of Santa Mon1ca Municipal Code Section 2309. Questions can be directed to the City Manager's Office, 393-9975 extension 301. DATED: January 27, 1983 TIME: 1:45 p.m. e It EMERGENCY PROCLAMATION IMPLEMENTATION ORDER NUMBER 3 Pursuant to the Emergency Proclamation issued by the Director of Emergency Services dated January 27, 1983, and pursuant to Santa Monica Municipal Code Section 2305, the following rules and regulations are promulgated: 1. Lessees will be permitted to enter the Pier on January 28, 1983, from 11:45 a.m. to 4:00 p.m. Entry shall be limited to the area east of the chain-link fence that blocks entry to the western portion of the Pier. Entry shall be under the same terms and conditions as set forth in Emer- gency proclamation Implementation Order Number 1. 2. Electricity is being restored in the area from Moby's Dock east. However, depending on emergency condi- tions, electricity may be terminated at any time. 3. On January 28, 1983, between the hours of 11:45 a.m. and 5:00 p.m., The Promenade between the Pier and the Pico Storm Drain shall be closed and no person, other than authorized emergency personnel, shall use such area of The Promenade. 4. No person, other than authorized emergency per- sonnel, shall enter the area of the pier west of the chain-link fence that blocks access to the western portion of the pier. s. The Director of Recreation and Parks may authorize any person (as defined in the Municipal Code) to remove any wood or timber from any City storage area provided the removal is necessary to assist in emergency operations in other locations and provided a hold harmless agreement is executed. 6r All previous orders, except to the extent modified herein,'shall remain in full force and effect. 7. Lessees will be permitted to enter the Pier on January 29, 1983, from 1:00 p.m. to 4:00 p.m. Entry shall be lim~ted to the area east of the cha1n-link fence that blocks entry to the western port~on of the Pier~ Entry shall be under the same terms and conditions as set forth in Emergency Proclamation Implementation Order Number 1. 2. Lessees will be permitted to enter the Pier on January 30, 1983, from 12:00 p.m. to 4:00 p.m. Entry shall be 11mited to the area east of the chain-link fence that blocks entry to the western portion of the P1er. Entry shall be under the same terms and conditions as set forth in Emergency Proclamation Implementation Order Number 1. 3. No person, other than authorized C~ty personnel, shall enter the area of the P~er west of the chaln-link fence that blocks access to the western port1on of the pier. 4. No person, other than authorized City personnel, shall enter any area of the P1er that is barricaded or other- wise restricted to public access. 5. On January 30, 19B3, City employees wlll conduct 1nspections of leased prem1ses and will assist lessees in assessing damage and restoring gas service. 6. Santa Monica Beach, both north and south of the Pler, is open to the public. 7. All prev10us orders, except to the extent modified herein, shall remain in full force and effect. 8. Pursuant to the Emergency Proclamation issued by the D1rector of Emergency Services dated January 27, 1983, and pursuant to Santa Monica Municlpal Code Section 2305, the follow1ng rules and regulations are promulgated: 1. Santa Monica Pier shall open to the general public at 8:00 a.m. on January 31, 1983, and shall remain open during regular operating hours. 2. No person, other than authorized City personnel, shall enter the area of the P1er west of the chain-link fence that blocks access to the western portion of the pier. 3. No person, other than authorlzed City personnel, shall enter any area of the Pler that lS barricaded or other- Wlse restricted to public access. 4. Unt1l damage to the pll~ng under Moby's Dock can be fully assessed, Moby's Dock shall remain closed to the public. 5.
