A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA SETTING A PUBLIC HEARING AND
INSTRUCTING THE SUPRINTENDENT OF STREETS TO
GIVE NOTICE TO PROPERTY OWNERS TO CONSTRUCT
GUTTERS AND TO RESURFACE THE STREET ON
BROADWAY BETWEEN ELEVENTH STREET AND
CLOVERFIELO BOULEVARD, ALL WITHIN THE CITY OF
SANTA MONICA
WHEREAS, there 1S a need to construct concrete gutters
and to resurface the street on Broadway from Eleventh Street to
Cloverf1eld Boulevard, all with1n the Clty of Santa Monica; and
WHEREAS, in accordance with Section 5860 ~ seq. of the
Streets and Highways Code procedures exist to notlfy property
owners of the1r duty to construct or cause to be constructed the
concrete
gutters and street resurfacing and to direct the
Superintendent of Streets to construct the concrete gutters and
street resurfaclng if not constructed or caused to be constructed
by the property owners; and
WHEREAS~ the City Council of the C1ty of Santa Monica on
its own motion may order the construction of the concrete gutters
and the street resurfacing;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:

SECTION 1. Pursuant to Section 5875 of the Streets and
Highways Code, the C1ty Council of the C1ty of Santa Mon1ca orders
the construct1on of concrete gutters and the street resurfaced on
Broadway between Eleventh Street and Cloverfleld Boulevard.
SECTION 2. Pursuant to Sectlon 5876 of the Streets and
Hlghways Codet the Superintendent of Streets shall notify, 10 the
manner required by law, the owners of property along Broadway from
Eleventh Street to Cloverfield Boulevard to construct or cause to
be constructed concrete gutters and street resurfacing. The
not1ce shall contain the lnformation requ1red by Sectlon 5879 of
the Streets and Highways Code and shall also specify the daYt hour
and place, as set forth in Sectlon 3 of this Resolution, where the
Clty Counc11 of the C1ty of Santa Monica will hear and pass upon
Objections or protests, if anYt which may be raised by any
property owner or other lnterested persons.
SECTION 3. That pursuant to Section 5878.1 of the
Streets and H1ghways Cadet the City Council of the City of Santa
Monica does hereby order and declare that on the 8th day of March,
1983, at 7:30 P.M.t in the Counc1l Chambers of City Hall, it will
hear and pass upon obJectlons or protests, if anYt WhlCh may be
raised by any property owner or other interested person.

SECTION 4.
The C1ty Clerk shall certlfy to the
adoption of thlS resolution and thenceforth and thereafter the
same shall be 1n full force and effect.
