A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA RATIFYING,
CONFIRMING, AND APPROVING RULES, REGULATIONS,
AND ACTIONS TAKEN BY THE DIRECTOR OF
EMERGENCY SERVICES AND PROCLAIMING THE
CONTINUED EXISTENCE OF THE LOCAL EMERGENCY
WHEREAS,
Mun~cipal
Code Section 2305 authorizes the
Director of Emergency Services to proclaim the existence or
threatened existence of a local emergency when the City of Santa
Monica is affected or likely to be affected by a pUblic calamity
and the City Council is not in session~ and
WHEREAS, commencing at 12:01 a.m. on January 27, 1983,
conditions of extreme peril to the safety of persons and property
have arisen within the City of Santa Monica caused by storm, high
tides, and heavy surf; and
WHEREAS, the City Council was not in session on January 27,
1983: and
WHEREAS, on January 27, 1983, the Director of Emergency
services of the City of Santa Monica did proclaim the existence
of a local emergency within the City of Santa Monica: and
WHEREAS, on February 1, 1983, the City Council adopted

(CCS), ratifying, confirming, and

approving, the proclamation of local emergency by the Director of
Emergency Services~ and
WHEREAS, pursuant to Municipal Code Section 2305, the
Director of Emergency Services has made and issued rules and
regulations reasonably related to the protection of life and
property as affected by such emergency; and
WHEREAS, pursuant to Government Code Section 8630, the City
council bas reviewed the need to continue the local emergency,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. The City Council of the City of Santa Monica
ratifies, confirms, and approves the the rules, regulations, and
actions taken by the Director of Emergency Services.
Specifically, the City Council of the City of Santa Monica
ratifies, confirms, and approves:
Emergency Proclamation Implementation Order Number 7.
Emergency Proclamation Implementation Order Number B.
Emergency Proclamation Implementation Order Number 9.
(A true and correct copy of each of these documents is attached
hereto marked Exhibit A.)
SECTION 2. The local emergency as proclaimed by the
Director of Emergency Services shall be deemed to continue to
exist in the City of Santa Monica until its termination is
proclaimed by the City Council of the city of Santa Monica.

SECTION 3. The City Clerk shall certify to the adoption of
this Resolution, and thenceforth and thereafter the same shall be
in full force and effect.

EMERGENCY PROCLAMATION IMPLEMENTATION ORDER NUMBER 7
Pursuant to the Emergency proclamation lssued by the
Dlrector of Emergency Services dated January 27, 1983, and
pursuant to Santa Monlca Munlclpal Code Section 2305, the
following rules and regulations are promulgated:
1. The decision of the Director of Recreation and
Parks to enclose the Deauville slte wlth a chainlink fence IS
hereby approved as an emergency measure to protect the
public. The slte 1S belng used as a storage area for
storm-related debris.
2. Based upon the structural examination by the
BU11ding Officer, Moby's Dock 1S permltted to open to the
publlC.
3. Dehrls in the Pacific Ocean caused by the recent
storm and damage to the pier may present an additional haz-
ard to SWlmmers. It is infeaslble to close the Pacific Ocean
to swimmers. The Dlrector of Recreation and Parks shall take
the followlng steps:
a. Place warning signs in English and in Spanish
on Santa Monica State Beach apprlslng potentlal users of the
possible danger of entering the Paciflc Ocean.
b. The warnlng should be in a form approved by
the Clty Attorney.
4. All previous orders, except to the extent modlfied
herein or in previous orders, shall remain in full force and
effect.
5. Any violatlon of these rules and regulations shall
constitute a vlolation of Munlcipal Code Section 2309.

Pursuant to the Emergency Proclamation issued by the
Director of Emergency services dated January 27, 1983, and
pursuant to Santa Monica Munic~pa1 Code Sect~on 2305, the
following rules and regulations are promulgated:
l. Based upon the recommendation of the Building
Officer, Director of General Services, and City Engineer, a
copy of WhiCh is attached hereto, and based upon the City
Council action on February 1, 1983, the Director of Emergency
SerVices orders the demolition as set forth in such recommen-
dation.
2. All previous orders, except to the extent modified
herein or in preViOUS orders, shall remain in full force and
effect.
3. Any violation of these rules and regulations shall
constitute a violation of Municipal Code Section 2309.

RECOMMENDATION TO DEMOLISH
TO: Director of Emergency Services
It is the professional opinion of the undersigned that
the area ~dentif~ed in ExhIbIt A attached hereto requires
immed~ate demolition ~n order to protect l~fe, health, and
property and In order to el~m~nate a dangerous condition.
The area is structurally unsound and could collapse at any
t~me, caus~ng damage to other parts of the pier and creatlng
a hazard to boats, swimmers, and users of the Beach. The
demolition is necessary before any reconstruct~on can com-
mence.

EMERGENCY PROCLAMATION IMPLEMENTATION ORDER NUMBER 9
Pursuant to the Emergency Proclamation issued by the
Director of Emergency Services dated January 27, 1983, and
pursuant to Santa Monica Mun1cipal Code Section 2305, the
following rules and regulat~ons are promulgated:
1. The following salvage steps shall be taken under
the coordination of the Director of Community and EconomlC
Development:
a. The owner of Santa Monica Sportsf~sh~ng will
be given 24 hour notice by the City of the time in which two
selected indiv1duals will be granted access to the upper
deck provided these lndividuals execute an appropr1ate hold
harmless agreement and comply with all d~rections of City
personnel. They will be accompanied by up to six members of
the Harbor Patrol, and will be allowed to remove property for
a period of no more than four hours. They will be glven the
use of an electric cart as well as hand-operated and electric
equ~pment. The determinat10n of the time of the operation
shall be made by the Harbor Patrol. The D~rector of Recrea-
tion and Parks shall direct th~s operation.
b. The Dlrector of General Services shall re-
cruit up to six C1ty employees to systematlcally remove
property from the boat lockers and buslnesses on the lower
deck. The employees must be properly equlpped before salvage
operations begin. The salvage operat1on shall be under the
directlon of the Director of General Services.
c. During the salvage operatlon, Harbor Guards
(and County Life Guards If avallable) shall stand-by for
necessary rescue operatlons. The Dlrector of Recreation and
Parks shall direct this operatlon.
d. As property 1S recovered, lt shall be brought
east of the chainlink fence and given to the Police Depart-
ment for identification, tagging, ~nventory, photographing,
and storage. Two representatlves of boat locker renters may
observe thlS operation east of the cha1nlink fence. Property
may be turned over to boat locker renters and buslness les-
sees upon proper ~dentiflcation and proof of ownership. Un-
claimed property shall be transported to the Airport for
storage until properly clalmed by owners. Captain Mike
Land1S shall direct thlS operation.
e. The Director of Community and Econom~c
Development shall provide appropriate notice to boat locker
renters and business lessees of the salvage operation.
f. The salvage operat1on shall be conducted at
such times as weather conditlons permit.

2. All prevlous orders, except to the extent modified
herein or in previous orders, shall remain in full force and
effect.
3. Any violation of these rules and regulat10ns shall
constitute a violat1on of Mun1c~pal Code Sectlon 2309.
