RESOLUTION NO. 6627(CC5)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS. DRIVEWAYS AND CURBS
(SR-83-40)
WHEREAS, the Street Superintendent of the City of Santa
Monica, pursuant to Sectlon 5600 to 5630 of the Streets and
Hlghways Code. commenced proceedings to cause the repalr of
damaged sidewalks. drlveways and curbs 10 the City of Santa Monica
at 2024 21st Street, 2018 21st Street, 2019 21st Street, 2031 21st
Street, 2017 21st Street, 2015 21st Street, 2014 21st Street, 2013
21st Street, 2002 21st Street, 2038 21st Street, 2007 21st Street,
2101 Pica Boulevard, 2029 Pica Boulevard and 2034 21st Street; and
WHEREAS, slxty days after sald order was served, the
work had not been completed by the owners or persons in possession
of the affected propertles, and the Superintendent of Streets
caused the work to be done; and
WHEREAS, the Superintendent of Streets gave the notice
required by Section 5616 of the Streets and Highways Code; and
WHEREAS, the Superintendent of Streets did file with the
City Council of the Clty of Santa Monica his report of repairs and
cost as requlred by Sectlon 5617 of the Streets and Highways Code;
and

WHEREASt upon the day and hour fixed for hearing by
Resolution Number 6605 (CCS), the Clty Council of the City of
Santa Monlca heard and passed upon the report of the
Superintendent of Streets together wlth all obJect1ons and
protests as required by Section 5618 of the Streets and Highways
Code;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore flled and above-descrlbed be and the same is
hereby conf1rmed.
SECTION 2. That all protests and obJect10ns of every
kind and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denied.
SECTION 3. That the cost of the repairs, as set forth
1n the report of the Super1ntendent of Streets, shall be assessed
agalnst the properties therein descr1bedt which properties front
upon the sidewalk upon Wh1Ch the repairs were made.
SECTION 4. That if such assessment 1S not paid within
the t1me perm1tted by lawt the same shall const1tute a special
assessment against and lien on the properties thereln described.
in the amount set forth in the report of the Superlntendent of
Streets, whTch lien shall cont1nue until the assessment and all
lnterest thereon 1S paid or until It is discharged of record.

SECTION 5. That lf the asssessment is not paid within
the time permltted by law, the Superlntendent of Streets, in
accordance wlth Section 5628 of the Streets and Hlghways Code,
shall deliver a Notice of Lien, prepared in the manner required by
Settlon 5626 of the Streets and Highways Code, to the County
Auditor who shall collect the assessment together with all other
taxes agalnst the property.
SECTION 6.
That the City Clerk shall certffy to the
adopt1on of this resolut1on and thenceforth and thereafter the
same shall be 1n full force and effect.
