R-6642 -~ e e CA:RMM:rmemerg6 City Council Meeting 3-8-83 Santa Monica, California RESOLUTION NUMBER 6642(CC5) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA RATIFYING, CONFIRMING, AND APPROVING THE PROCLAMATION OF LOCAL EMERGENCY ISSUED BY THE DIRECTOR OF EMERGENCY SERVICES AND THE RULES, REGULATIONS, AND ACTIONS TAKEN PURSUANT THERETO WHEREAS, MunlClpal Code Section 2305 authorizes the Director of Emergency Services to proclalm the existence or threatened eXistence of a local emergency when the City of Santa Monica IS affected or likely to be affected by a public calamity and the City Council is not in session; and WHEREAS, commencing on March 1, 1983, conditions of extreme peril to the safety of persons and property have arisen wi thin the City of Santa Monica caused by storm, high tIdes, and heavy surf; and WHEREAS, the City Council was not in session at the time of the extreme peril arose; and WHEREAS, on March 1, 1983, the Director of Emergency Services of the City of Santa Monlca did proclaim the eXistence of a local emergency within the Clty of Santa Monica; and WHEREAS, pursuant to Municipal Code Section 2305, the Director of Emergency SerVices has made and issued rules and 1 e e regulations reasonably related to the protection of llfe and property as affected by such emergency, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The City Councll of the City of Santa Monica ratifles, confirms, and approves the proclamatIon of local emergency by the DIrector of Emergency ServIces and the rules, regulations, and actions taken pursuant thereto. Specifically, the City Councll of the CIty of Santa Monica ratlfies, confirms, and approves: Resolution Proclaiming EXlstence of Local Emergency. Resolutlon Requestlng Governor to Request Extension of Presldentlal DeclaratIon. Emergency Proclamation ImplementatIon Order Number l. Emergency Proclamatlon Implementation Order Number 2. Emergency Proclamatlon Implementation Order Number 3. (A true and correct copy of each of these documents is attached hereto marked Exhibit A.) SECTION 2. The local emergency as proclalmed by the DIrector of Emergency Services shall be deemed to contlnue to eX1st 1n the Clty of Santa Monica untIl its termlnation is proclalmed by the CIty Council of the Clty of Santa Monica. SECTION 3. A copy of this resolutlon shall be forwarded to the State DIrector of the Office of Emergency Services wi th a request that he fInd lt acceptable in accordance with the proviSIons of the Natural Disaster Assistance Act. That the CIty Council of the City of Santa MonIca is not In seSSIon and cannot be immediately called into session. The Santa MonIca PIer has been closed and shall remaIn closed untIl further order of the Director of Emer- gency SerVIces. 2. emergency except by SerVIces. No person shall enter Santa Monica PIer except crews of State, county, or local government or authorIzation of the Director of Emergency 3. Santa Monica Beach south of the pier to the south CIty lImits 1S closed. The parking lot Immed1ate1y north of the Pler and such Beach area as IS determIned necessary by CIty emergency personnel IS closed. No person shall enter this area except emergency crews of State, county, or local government or except by authorIzatIon of the Director of Emergency Ser- VIces. 5. DurIng emergency clean up operat1ons on Santa Monica Beach, The Promenade between the Pier and the PICO Storm Drain shall be closed and no person, other than authorIzed emergency personnel or other persons author1zed by the Director of Emergency Services shall enter or use such area of The Promenade. 6. Lessees shall be permItted to enter the PIer at such times and under such condItIons specIfIed by the DIrector of Emergency Services. Such entry shall be at the risk of the lessee and subJect to the execution of a hold harmless agreement. 7. '.. e EMERGENCY PROCLAMATION IMPLEMENTATION ORDER NUMBER 2 Pursuant to the Emergency Proclamation issued by the D~rector of Emergency Services dated March 1, 1983, and pursuant to Santa Monica Municipal Code Section 2305, the follow~ng rules and regulations are promulgated: 1. The Santa Monica pier shall open to the publIC at 12:00 p.m. on March 3, 1983. The Santa Mon~ca PIer is open to lessees commencing at 9:00 a.m. on March 3, 1983, except that access to any portion of the PIer that remains closed is subJect to the authorization of the DIrector of Emergency Services and the execution of a hold harmless agreement. Vehicle access to the PIer shall be as limIted by the DIrector of Emergency SerVIces. 2. No person shall enter any closed, posted, or barri- caded area of Santa Monica Pier except emergency crews of State, county, or local government or except by author~zatlon of the Director of Emergency Services. 3. The parking lot immediately north of the PIer ~s open. 4. All previous orders, except to the extent modIfied hereIn, shall remain in full force and effect. 5. The Director of General Services and the City Engineer are hereby directed to take emergency construction and repair work, including the supervision of any private contractors employed by the City, to prevent addItional damage to the Pier. 2. All previous orders, except to the extent modified herein, shall remain in full force and effect. 3.
