RESOLUTION NO. 6204

A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SANTA MONICA CONFIRMING
THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING GUTTER DISTRICT
NO.3 ON SECOND AND FOURTH STREETS
WHEREAS, the City Council of the City of Santa Monica,
pursuant to Section 5870, et seq., of the Streets and Highways
Code, commenced proceedings to cause the construction of concrete
gutters on Second and Forth Streets between Broadway and Colorado
Avenue Boulevard in the City of Santa Monica,
WHEREAS, a public hearing was held on said matters, and
thereafter said City Council ordered the construction to be
accomplished; and
WHEREAS, sfxty (60) days after said order was served,
the work had not been completed by the owners or persons in
possession of the affected properties, and the Superintendent of
Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets did file with the
City Council of the City of Santa Monica his reports of such
work, and a hearing thereon was called by Resolution No. 6169
(CCS); and
WHEREAS, the City Council conducted a noticed hearing to
consider any protests or objections to the Report of Work;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the
Superintendent of Streets, heretofore filed and above-described,
be and the same is hereby confirmed.

SECTION 2. That all of said protests and objections of
every kind and nature to the construction or to the assessments
and all appeal s therefrom to said City Council be and the same
hereby are overruled and denied.
SECTION 3. That the cost of the construction, as set
forth in the Report, shall be assessed against the properties
herein described, which properties front upon the improvement so
planned.
SECTION 4. That if such assessment is not paid within
the time permitted by law, the same shall constitute a special
assessment and lien against the properties described therein, in
the amount set forth in the Report, which lien shall continue
until the assessment and all interest thereon is paid.
SECTION 5. That if the assessment is not paid within
the time permitted, the City Clerk shall deliver a Notice of
Lien, signed by the Superintendent of Streets, as provided in
Section 5891 of the Streets and Highways Code of the State of
California, to the County Assessor and Tax Collector, who, in
accordance with applicable law, shall collect said assessment
together wih all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the
adoption of this Resolution.
