RESOLUTI ON NO. 6206
A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA FINDING AND DETERMINING
THE PUBLIC INTEREST, CONVENIENCE AND NECESSITY
FOR ACQUIRING, AND AUTHORIZING THE CONDEMNATION
OF AN EASEMENT TO CERTAIN REAL PROPERTY FOR A
PUBLIC USE, TO WIT: A PUBLIC WALKWAY.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLm~S:
SECTION 1. That the Clty Council of the City of Santa Monica
finds and determines that the publlC interest, convenience and necessity
require the development of a public walkway, to wit: A stairway at Fourth
Street between Ocean Avenue and Adelaide Drive in the City of Santa Monica.
SECTION 2. That the City Council of the City of Santa Monica
finds and determines that in order to construct said public way, the publlC
lnterest, convenience and necessity require the acquisition by the City of
Santa Monica of an easement in and to the real property in this section
hereinafter described. That said real property is situated in the City of
Santa Monica, County of Los Angeles, State of California and is more particu-
larly described as follows:
"That portion of Lot E, Tract No. 7433, as per
map recorded in Book 96, Pages 74 to 76 inclusive,
of Maps, in the office of the County Recorder of
Los Angeles County, bounded and described as
follows:

Beginning at the most southerly corner of said
lot, said corner lying 1n the northeasterly line
of the strip of land, 10 feet wide, shown as Walk
on the map of said tract; thence northeasterly
along the southeasterly line of said lot a distance
of 15 feet; thence northwesterly at right angles
from said southeasterly line to the northwesterly
line of said lot; then southwesterly along said
northwesterly line to the southwesterly line of
said lot; thence southeasterly along said
southwesterly line to the point of beginning.
The City Council of the City of Santa Monica further finds
and determines that the acquisition of all of the above described real
property is necessary for the development and construction of said public
way.
SECTION 3. That the City Council of the City of Santa Monica
finds and determines:
A. That a pub11c walkway is a use authorized by law.
B. That the public interest, convenlence and necessity
require the acquisition of said easement for a public walkway.
C. That the acquisition of the easement to said real property
is necessary for the construction and development of a pUblic walkway.
D. That said easement to be used for said public walkway,
is located in a manner which w1ll be most compatible for the greatest public
good and the least private 1njury.

SECTION 4. That the City Attorney of the City of Los Angeles
is hereby authorized, empowered and directed to bring an action or actions
in the name of the City of Santa Monica in the Superior Court of the State
of California, for the County of Los Angeles. for the condemnation of the
easement in and to the real property described in Section 2 of this resolution,
and to take all steps necessary for the condemnation of the easement to said
real property in the name of the Clty of Santa Monica, and to acquire
immediate possession of all of said property.
SECTION 5. The City Clerk shall certify to the adoption of
this resolution, and thenceforth and thereafter the same shall be in full
force and effect.
