A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA AUTHORIZING UTILITY TAX REFUNDS
WHEREAS, the California Public Utilities Commission
has ordered the Southern California Gas Company to refund
certain natural gas rates paid by service users during the
period from January 1, 1981, to February 28, 1981, and
WHEREAS, the decision results in service users
overpaying the City's Utility Users Tax during such period,
and
WHEREAS, the City of Santa Monica desires to refund
the excess tax payments paid by service users,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
RESOLVES AS FOLLOWS:
SECTION
1.
Pursuant
to
Municipal
Code
Section 6632(b), Southern Califonia Gas Company is authorized
to
re fund
to the service user or credlt to charges
subsequently payable by the service user the amount of excess
Utility Users Tax paid for service durlng the period from
January 1, 1981, to February 28,
1981. Southern California
Gas Company shall be entitled to a credit against current tax
collections in the actual amount of such refunds and credits.

SECTION 2.
The Mayor shall sign and the Clerk
shall
attest
to the passage of this resolution, and
thereafter it shall be in full force and effect.
