A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA
RESCINDING THE HOUSING ELEMENT OF THE LAND USE PLAN OF THE
SANTA MONICA COASTAL PROGRAM, AND STATING CURRENT POLICIES
RELATING TO HOUSING AND COMMERCIAL DEVELOPMENT WITHIN THE
COASTAL ZONE.
WHEREAS, on January 14, 1981, the City Council adopted
Resolution No. 6163, adopting the Land Use Plan of the Santa
Monica Local Coastal Program; and
WHEREAS, on April 14, 1981, four new members were
elected to the City Council; and
WHEREAS, on April 22, 1981, the City Council adopted
Ordinance No. 1205, imposing a moratorium on commercial and
res1dential development in the City; and
WHEREAS, Section 1 of Ordinance 1205 contains 14
find1ngs supporting enactment of the moratorium, including:
1. There exists within the City a housing crisis
because of the serious shortage of housing affordable by persons
and families of low and moderate income;
2. The new jobs created by commercial developments
in the City have aggravated the housing crisis by generating
addit10nal demands on the limited supply of housing;

3. The City Council will explore amending the
City's zoning regulations to require low and moderate income
housing opportunities in all residential developments and to
requIre commercial developers to meet the housing needs generated
by their developments through on-site and off-site housing;
4. CommercIal and residential development in the
City has not taken into account the demand for additional pOlice
and protective services, traffic, energy conservation, sewage
capacity, and the interests of adjoining residential
neighborhoods;
5. The public peace, health, and safety is
threatened by continuing commercial and residential development
prior to comprehensive review and revision of the City's zoning,
planning, subdivision, and building regulations; and
WHEREAS, Section l(m) of Ordinance 1205 declares that
the Land Use Plan of the Local Coastal Program has been completed
and must be implemented; that the goals of the Local Coastal
Program are consistent with the intent of the moratorium; and
that to allow development to proceed within the Coastal Zone
would be detrimental to the implementation of the Local Coastal
program and to the best interests of the CIty; and
WHEREAS, Certain policies expressed in the adopted Land
Use Plan of the Local Coastal Program do not reflect the current
policy of the City Council, particularly with respect to
inclusionary housing programs and intensity of commercial

development (including the related issue of heights of structures
along Ocean Avenue); and
WHEREAS, The Interpretive Guideline on New Construction
of Housing of the California Coastal CommissIon, as revised May
5, 1981, Part IV(C), provide that a Regional Commission may adopt
a policy of inclusionary housing which is more liberal than the
Commission's general guideline where a local community's
circumstances differ from the general case to the extent that a
greater degree of inclusion is feasible; and
WHEREAS, The City Council desires to state its current
policies in order to permit the Regional Commission to adopt
policies consIstent with the City's and to require inclusionary
housing for all new construction within the Santa Monica Coastal
Zone; and
WHEREAS, The City Council desires to rescind that
portion of the currently adopted Land Use Plan of the Santa
Monica Coastal program which is inconsIstent with or does not
adequately address the current concerns of the Council;
THE CITY COUNCIL OF THE CITY OF SANTA MONICA RESOLVES:
SECTION 1. The Land Use Plan of the Santa Monica
Coastal Program, as adopted by City Council Resolution No. 6163,
is hereby rescinded.
SECTION 2. In particular, the following policies are
declared to be inconsistent with the current policy of the City:

a. The entire statement of Housing Policies, insofar as
it does not make adequate provision for inclusion of affordable
housing for persons and families of low and moderate income.
b. visual Resources pOlicy 3, insofar as it does not
adequately address problems of height and bulk of developments
within the Coastal zone, particularly on Ocean Avenue.
SECTION 3. In light of the serious shortage of
residential housing affordable to persons and families of low and
moderate income in the City, which is currently being aggravated
by continuing development of commercial structures and luxury
housing, it is the policy of the Santa Monica Coastal Program to
require the inclusion of low and moderate income housing
opportunities on-site for all residentIal and commercial
construction in the Coastal Zone.
SECTION 4. Because 75% of the population of the City of
Santa Monica resides in rental housing, because of the
seriousness of the housing criSIS In the City, and because
continued development wIthin the CIty without adequate provision
for affordable housing threatens severe displacement of
residents, particularly, the poor, elderly, ethnic minorities,
and families with children, the circumstances in Santa Monica are
different from the general case to the extent that a greater
degree of direct inclusion of affordable housing than is provided
in the General Guideline on New Construction of Housing of the
California Coastal Commission is feasible and consistent with the
policies of the Coastal Act. It is further the pOlicy of the

City that all condominium conversions in the coastal zone be
opposed and that none be approved.
SECTION 5. It is the policy of the City that commercial
development in the Coastal Zone be limited to buildings and
structures of no more than two stories, no more than 30 feet in
height, and gross floor area no greater than the total area of
the building site. Further, it is the policy of the City that
larger projects must include adequate provision for inclusion of
residentIal housing, must have an analysis of the traffic impact
caused by the project and mitigate adverse effects, and must pay
in-lieu recreation fees to compensate for the increased use of
City recreation facilities caused by the project.
SECTION 6. In order to meet bulk, density, and access
concerns, it is the policy of the City that no permit for
demolition of a structure in the Coastal Zone be issued unless
the rehabilitation or renovatIon of the structure is evaluated as
the first priority alternative.
SECTION 7. The Regional Coastal Commission is hereby
requested to adopt a resolution declaring that the Commission.s
general guidelines alone would not result In full compliance with
Coastal Act POlICY 30213 within the City of Santa Monica, and to
adopt a policy declaring that inclusion of affordable housing
opportunities for persons and families of low and moderate income
will be required for all new construction within that portion of
the Coastal Zone lying within the City of Santa Monica.

SECTION 8. The Mayor shall sign and the City Clerk
shall attest to the passage of this Resolution and thereafter it
shall be in full force and effect.
