RESOLUTION NO. 6470(CCS)

A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA CONFIRMING THE REPORT OF THE
SUPERINTENDENT OF STREETS REGARDING REPAIRS TO
DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS
(SR-Bl-24)
WHEREAS, the Street Superlntendent of the Clty of Santa
Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and
Hlghways Code, commenced proceedlngs to cause the repalr of
damaged sldewalks, drlveways and curbs ln the Clty of Santa
Monlca; and
WHEREAS, Slxty days after sald order was served, the
work had not been completed by the owners or persons In possesslon
of the affected properties, and the Superlntendent of Streets
caused the work to be done; and
WHEREAS, the Superlntendent of Streets gave the notlee
requlred by Sectlon 5616 of the Streets and Hlghways Code; and
WHEREAS, the Superlntendent of Streets dld file wlth the
Clty Councll of the Clty of Santa Monlca hlS report of repalrs and
cost as required by Sectlon 5617 of the Streets and Hlghways Code;
and
WHEREAS, upon the day and hour flxed for hearlng by
Resolutlon Number 6451 (eCS), the Clty Counell of the Clty of
Santa
Monlca
heard
and
passed
upon the report of the
Superlntendent
of Streets together wlth all objectlons and
protests as requlred by Sectlon 5618 of the Streets and Hlghways
Code;

NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report of the Superintendent of
Streets heretofore fl1ed and above-descr1bed be and the same lS
hereby conflrmed.
SECTION 2. That all protests and objectlons of every
klnd and nature to the report of the Superlntendent of Streets be
and the same are hereby overruled and denled.
SECTION 3. That the cost of the repairs, as set forth
In the report of the Superlntendent of Streets, shall be assessed
agalnst the propertles thereln described. WhlCh properties front
upon the sldewalk upon WhlCh the repalrs were made.
SECTION 4. That lf such assessment 15 not pald wlthln
the t1me permltted by law. the same shall constltute a special
assessment agalnst and 11en on the propertles thereln described.
In the amount set forth In the report of the Superlntendent of
Streets. WhlCh 11en shall contlnue untl1 the assessment and all
1nterest thereon lS pald or untl1 lt 15 dlscharged of record.
SECTION 5. That lf the a5sses5ment 1S not pa1d w1th1n
the tlme permltted by law. the Super1ntendent of Streets. 1n
accordance w1th Sectlon 5628 of the Streets and Hlghways Code.
shall de11ver a Notlce of Llen, prepared In the manner requ1red by
Sectlon 5626 of the Streets and Hlghways Code. to the County
Audltor who shall collect the assessment together w1th all other
taxes agalnst the property.

SECTION 6.
That the C,ty Clerk shall cert,fy to the
adoptlon of thlS resolutlon and thenceforth and thereafter the
same shall be 1 n full force and effect.
