R-6495 e e RESOLUTION NO. 6495(CC5) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA AUTHORIZING THE CITY MANAGER TO EXECUTE AN AMENDr-fENT TO THE NEMORANDUH OF UNDERSTAND ING BETWEEN THE CITY OF SANTA MONICA AND THE MUNICIPAL EMPLOYEES ASSOCIATION REPRESENTING PROFESSIONAL, ADMINISTRATIVE, CLERICAL AND TECHNICAL EMPLOYEES \ffiEREAS, ~t is the mutual desire of the City and the Municipal Employees Association Representing Professional ,Administrative , Cleri- cal and Technical Employees to amend the Memorandum of Understanding entered into in January, 1981. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: Section 1: The City Council does hereby approve and authorize the City Manager to execute the amendment to the Memorandum of Under- standing executed by the representatives of the Municipal Employee's Association Representing Professional, Administrative, Clerical and Technical Employees, a copy of which is attached hereto. Section 2: The City Clerk shall certify to the adoption of this Resolution and thenceforth and thereafter the same shall be in full force and effect. APPROVED AS TO FORM ~~~ ROBERT M. ' . e AGREEMENT AMENDING MEMORANDUM OF UNDERSTANDING THIS AGREE~IENT entered into this 16th. day of June 1982, by and between the CITY OF SANTA MONICA~ a municipal corporation (hereinafter I1City"), and the Municipal Employee's Association Representing Professional, Administrative~ Cleri- cal and Technical Employees (hereinafter "MEA/PACTI1) is made with reference to the following: R E C I TAL s: A. The City and }ffiA/PACT entered into a memorandum of understanding in January, 1981, entitled "Memorandum of Under- standing Between the City of Santa Monica and the Municpa1 Em- p1oyee's Association Representing Professional, Administrative, Clerical and Technical Employees (MEA/PACT)II (hereinafter "Memorandum of Understandingll). B. It is the mutual desire of City and MEA/PACT to amend certain of the terms of the Memorandum of Understanding. NOW, THEREFORE, it is mutually agreed by and between the City and }~A/PACT as follows: 1. On and after July 1, 1982, Section 1, UParties to the Memorandum," is amended to read as follows: This Memorandum of Understanding has been prepared pursuant to the terms of Ordinance 801 (eGS) of the City of Santa Monica, which Ordinance is hereby in- corporated by reference as if fully set forth herein and has been executed by the City Manager on behalf of Management officials of the City and by the Muni- cipal Employee's Association Representing Profession- al, Administrative, Clerical and Technical Employees e -2- e (MEA/PACT), on behalf of employees occupying the line item full-time e~ployment position classi- ficat~ons set forth in Exhibit A (Revised) which is attached hereto and made a part hereof From time to time, addit~onal positions may be included under the terms of this Memorandum of Understanding w~thout formal amendment of the agreement, provided that ~ffiA/PACT finds those posit~ons to be appropriately within its unit composition standards and that the Municipal Employee Relations Officer finds that their in- clusion is not inappropr~ate under the terms of Ordinance Number 801 (CCS) Such additions shall be agreed upon ~n writing and will become effec- tive upon execution by authorized representativeCs) of MEA/PACT and the Municipal Employee Relations Officer. 2. On and after July 1, 1982, Section 36, ItMedical Insurance" is amended to read as follows During the remainder of the life of this agreement, the City shall provide full fee-far-service medi- cal and fee-for-service or group dental coverage for employees covered hereunder and their eligible dependents. In addition, the City shall provide optional pre-paid health maintenance plan type coverage for employees and eligible dependents. All medical and dental insurance coverage pro- vided by the Clty during the remainder of the term of this agreement for employees covered here- under and their el~gible dependents shall be at no cost to the employee. All such health service programs shall contain benefits essentially equal to or better than plans offered ~n December, 1980. e -3- e As soon as practicable, representatives of the City, r-~A/PACT and other recognized employee organizations shall jointly explore the feas~- bility of improving insurance benefits and/or changing insurance carriers As par t of the joint process, MEA/PACT shall be provided the opportunity to suggest and evaluate insurance alternatives. Subject to the provisions set forth in the preceding paragraph, nothing here- in shall be construed as an agreement by the City to change carriers, to change insurance benefits, or to limit its right to f~nally de- termine or make changes in carrier or benefits. 3. On and after July 1, 1982, T1Exhibit A (Revised) Tf attached hereto and incorporated herein by reference shall be sub- stituted .in place and instead of "Exhibit All to the Memorandum of Understanding. 4. Except as expressly modified herein, all other terms and covenants set forth in the Hemorandum of Understanding shall remain the same and shall be in full force and effect.
