A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING AND INSTRUCTING THE SUPERINTENDENT
OF STREETS TO GIVE NOTICE TO PROPERTY OWNERS
TO CONSTRUCT GUTTERS ON FOURTH STREET BETWEEN
BROADWAY AND ARIZONA, All WITHIN THE CITY OF
SANTA MONICA
WHEREAS, there is a need to construct concrete gutters along Fourth
Street from Broadway to Ar1zona, all within the C1ty of Santa Monica; and
UHEREAS, 1n accordance with Sect10n 5860 ~ seq. of the Streets and
H1ghways Code procedures exist to not1fy property owners of their duty to
construct or cause to be constructed the concrete gutters and to direct the
Superlntendent of Streets to construct the concrete gutters if not constructed
or caused to be constructed by the property owners, and
WHEREAS, the City Council of the C1ty of Santa Monlca on its own motion
may order the construct1on of the concrete gutters;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOllOWS.
SECTION 1. Pursuant to Sect10n 5875 of the Streets and H1ghways Code.
the C1ty Counci1 of the City of Santa Monica orders the constructlon of con-
crete gutters along Fourth Street from Broadway to Arizona.
SECTION 2. Pursuant to Sectlon 5876 of the Streets and Highways Code,
the Superintendent of Streets shall notify, in the manner requ1red by law,
the owners of property along Fourth Street from Broadway to Arizona to
construct or cause to be constructed concrete gutters. The notice shall
conta1n the information requ1red by Sectlon 5879 of the Streets and H1ghways

Code and shall also spec1fy the day, hour and place, as set forth in Section
3 of this Resolution, where the City Council of the City of Santa Mon1ca
will hear and pass upon ObJect10ns or protests, 1f any, wh1ch may be
ra1sed by any property owner or other interested persons.
SECTION 3. That pursuant to Section 5878.1 of the Streets and High-
ways Code, the C1ty Council of the City of Santa Monlca does hereby order
and declare that on the 13th day of July 1982, at 7:30 P.M.. 1n the Council
Chambers of Clty Hall. lt wlll hear and pass upon objections or protests,
if any, WhlCh may be raised by any property owner or other 1nterested person.
SECTION 4. The City Clerk shall certlfy to the adoption of this reso-
lut10n and thenceforth and thereafter the same shall be in full force and
effect.
