R-6503 ~ . e RESOLUTION NO. 6503(CCS) (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO FORM THE SANTA MONICA CITYWIDE LIGHTING AND LANDSCAPING ASSESSMENT DISTRICT FOR THE MAINTENANCE AND SERVICING OF PUBLIC LIGHTING AND LANDSCAPING FACILITIES AND TO LEVY AND COLLECT ASSESSMENTS PURSUANT TO THE LANDSCAPING AND LIGHTING ACT OF 1972 WHEREAS, the City Council initiated proceedings to form an Assessment District pursuant to the provisions of the Landscaping and Lighting Act of 1972 (Streets and Highways Code Section 22500 et seq.); and WHEREAS, the City Council ordered the Engineer to prepare a report pursuant to Streets and Highways Code Section 22565; and WHEREAS, the Engineer did prepare and file such a report and the same was approved by the City Council, NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. The public interest and convenience require and it is the intention of the City Council of the City of Santa Monica to order the formation of an Assessment District 1 '. e e and to levy and collect assessments pursuant to the provisions of Landscaping and Lighting Act of 1972. SECTION 2. The improvements to be undertaken consist of the maintenance and servicing of public lighting and landscaping facilities in, on and along the public streets within the City. The maintenance and servicing is to lnclude, but not be limited tat the furnishing of services and materials for the ordinary and usual maintenance, operation, and servicing of public lighting and public landscaping, the repair, removal or replacement of all or any part of any public lighting or public landscaping, the provision for the life, growth, health, and beauty of public landscaping, including cultivation, irrigation, trimming, spraying, fertilizing, or treating for disease or injury, the removal of trimmings, rubbish, debris and other solid waste from public landscaping, the furnishing of electric current or energy, gas, or other illuminating agent for any public lighting, and the furnishing of water for the irrigation of any public landscaping. SECTION 3. The proposed Assessment District, designated as Santa Monica Citywide Lighting and Landscaping Assessment District generally encompasses all of the properties within the City of Santa Monica, except the areas as designated in the Engineer's report. 2 .... . e SECTION 4. Reference is hereby made to the Engineer's report for a full detailed description of the improvements, the boundaries of the assessment district and any zones therein, and the proposed assessments upon assessable lots and parcels of land within the assessment district. The Engineer's report is on file in the office of the City Clerk and is available for inspection. SECTION 5. The proposed maintenance and servicing will be to the benefit of the property lying within the described boundaries of the proposed assessment district, as described and defined in said Engineer's report, and since there is general public benefit derived from the proposed improvements, the City Council may at its discretion make contribution to the assessment district from public funds in an amount to be determined by the City Council, which contribution shall be deducted from the total costs to be assessed. For the 1982-83 Fiscal Year, the contribution is proposed to be $613,286. SECTION 6. Notice hereby is given that on July 13, 1982, at 7:30 P.M. in the City Council Chambers of the City of Santa Monica in the City Hall, 1685 Main Street, Santa Monica, California, all interested persons may appear before the City Council and be heard concerning the formation of the assessment district, the extent of the assessment district, the maintenance and service to be performed, the levy of the proposed assessment, and all other matters relating thereto. Protests must be in writing and must be filed with the City Clerk prior to the 3 . e conclusion of the hearing. Any such protest shall state all grounds of the objection and if filed by the property owner shall contain a description sufficient to identify the property. SECTION 7. The City Clerk shall cause notice of the hearing to be given by causing this Resolution of Intention to be published, posted, and mailed in the manner required by law. SECTION 8. The City Clerk shall certify to the adoption of this Resolution, and thenceforth and thereafter the same shall be in full force and effect.
