A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF SANTA MONICA INSTRUCTING THE
SUPERINTENDENT OF STREETS TO GIVE NOTICE TO
PLANT TREES TO PROPERTY OWNERS ALONG BROADWAY
FROM LINCOLN BOULEVARD TO FOURTEENTH STREET,
ALL WITHIN THE CITY OF SANTA MONICA
WHEREAS~ there is a need to plant trees along Broadway
from Lincoln Boulevard to Fourteenth Street~ all within the City
of Santa Monica; and
WHEREAS~ in accordance with Section 5870 et seq. of the
Streets and Highways Code procedures exist to notify property
owners of their duty to plant or cause to be planted trees and to
permit the Superintendent of Streets to plant the trees if not
planted or caused to be planted by the property owners; and
WHEREAS, the City Council of the City of Santa Monica
on its own motion may order the planting of trees;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA
MONICA DOES RESOLVE AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of the Streets and
Highways Code, the City Council of the City of Santa Monica
orders
the planting of trees along Broadway from Lincoln
Boulevard to Fourteenth Street.
SECTION 2. Pursuant to Section 5876 of the Streets and
Highways Code~ the Superintendent of Streets shall notify, in the
manner required by law, the owners of property along Broadway
from Lincoln Boulevard to Fourteenth Street to plant or cause to

be planted trees.
The notice shall contain the information
required by Section 5879 of the Streets and Highways Code and
shall also specity the day, hour and placeJ as set forth in
Section 3 of this Resolution, where the City Council of the City
of Santa Monica will hear and pass upon objections or protests,
if any, which may be raised by any property owner or other
interested persons.
SECTION 3.
That pursuant to Section 5878.1 of the
Streets and Highways Code, the City Council of the City of Santa
Monica does hereby order and declare that on the 28th day of
September, 1982, at 7:30 p.m'J in the Council Chambers of City
Hall, it will hear and pass upon objections or protests, if any,
which may be raised by any property owner or other interested
person.
SECTION 4.
The Ci ty Cl erk shall certi fy to the
adoption of this resolution and thenceforth and thereafter the
same shall be in full force and effect.
