A RESOLUTION OF THE CITY COUNCIL OF THE
CITY OF SANTA MONICA SETTING A PUBLIC
HEARING AND INSTRUCTING THE SUPERINTENDENT
OF STREETS TO GIVE NOTICE TO PROPERTY OWNERS
TO CONSTRUCT GUTTERS AND TO PLANT TREES ON
WILSHIRE BOULEVARD BETWEEN OCEAN AVENUE AND
TWENTY-FIRST STREET. ALL WITHIN THE CITY OF
SANTA MONICA
WHEREAS. there is a need to construct concrete gutters and to plant trees
along Wilshire Boulevard from Ocean Avenue to Twenty-first Street, all within
the City of Santa Monica; and
WHEREAS. in accordance wlth Sectlon 5870 et seq. of the Streets and Hlgh-
ways Code procedures eXlst to notify property owners of their duty to construct
or cause to be constructed the concrete gutters and to plant or cause to be
planted trees and to direct the Superintendent of Streets to construct the
concrete gutters and to plant the trees if not constructed or caused to be con-
structed by the property owners; and
~HEREAS. the City Councll of the City of Santa Monlca on its own motlon may
order the construction of the concrete gutters and th~ plantlng of trees.
NOW, T~EREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1. Pursuant to Section 5875 of tne Streets and ~iqhways Code, the
Ci ty CouncU of the CHy of Santa Manl ca orders the constructfon of concrete
gutters and the planting of trees along ~ilshire Boulevard from Ocean Ayenue
to Twenty-first Street.
SECTION 2. Pursuant to Section 58]6 of the Streets and ~ighways Code. the
$uperlntendent of Streets shall notify. In the manner reqaired hy law, the
owners of property along Wilshire Boulevard from Ocean Avenue to Twenty-firs,t

Street to construct or cause to be constructed concrete gutters. and to plant
or cause to be planted trees. The notlce shall contain tne lnformation required
by Section 5879 of the Streets and Highways Code and shall also specify th~ day,
hour and place. as set forth In Section 3 of this Resolution. where the City
Council of the City of Santa Monlca will hear and pass upon objections or pro-
tests. if any. which may be raised by any property owner or other interested
persons.
SECTION 3.- That pursuant to SectlOn 5878.1 of the Streets and Highways
Code, the City Councll of the C1ty of Santa Monica does hereby order and declare
that on the 22nd day of September 1981. at 7:30 P.M.. in the Council Chambers
of C1ty Hall, it will hear and pass upon objections or protests, if any, which
may be raised by any property owner or other interested ~erson.
SECTION 4. The City Clerk shall certify to the adoption of this resolu-
tion and thenceforth and thereafter the same sha11 De in full force and effect.
