A RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF SANTA MONICA
AUTHORIZING UTILITY TAX REFUNDS
WHEREAS, the Cal ifornia PubllC Util ities Commission
has ordered the Southern Callfornla Gas Company to refund
certaln amounts to lts customers relatlng primarily to
refunds recei ved by the Gas Company from its interstate
suppllers, and
WHEREAS, the decision results in service users
overpaying the Clty.S Utll ity Users Tax during such period,
and
WHEREAS, the Clty of Santa Monica desires to refund
the excess tax payments pald by serVlce users,
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF
SANTA MONICA RESOLVES AS FOLLOWS:
SECTION 1.
Pursuant to Municipal Code Section
6632(b), Southern Cal ifonia Gas Company is authorlzed to
refund to the service user or credit to charges subsequently
payabl e by the serVlce user the amount of excess Utillty
Users Tax paid for service relating primarily to refunds
received by the Gas Company from its lnterstate suppllers.
Southern Californla Gas Company shall be entltled to a credlt
agalnst current tax col1ectlons in the actual amount of such
refunds and credits.

SECTION 2. The Clty Clerk shall certify to the adoption of
thlS resol utlon, and thereafter it shall be In full force and
effect.
