A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF SAL'\l"TA MONICA FINDING AND
DETERMINING THE PUBLIC INTEREST, CON-
VENIENCE AND NECESSITY FOR ACQUIRING,
AND AUTHORIZING THE CONDEMNATION OF
AN EASEMENT TO CERTAIN REAL PROPERTY
FOR A PUBLIC USE, TO WIT: A PUBLIC
WALKWAY.
THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE
AS FOLLOWS:
SECTION 1. That the C1ty Councll of the Clty of Santa
Monica finds and determines that the public interest, con-
venience and necessity require the develooment of a public
walkway, to wit: A stairway at Fourth Street between Ocean
Avenue and Adela1de Dr1ve 1n the C1ty of Santa Mon1ca.
SECTION 2. That the Clty Counc1l of the C1ty of Santa
Monlca flnds and determ1nes that in order to construct said
publ1C way, the publlC lnterest, convenience and necess1ty
requ1re the acquisltion by the Clty of Santa Mon1ca of an
easement in and to the real property 1n th1S sectlon here1n-
after descrlbed. That sald real property lS sltuated in the
C1ty of Santa Monlca, County of Los Angeles, State of Cali-
fornia and 1S more part1cularly descr1bed as follows:
That port1on of Lot E, Tract No. 7433, as
per map recorded ln Book 96, Pages 74 to
76 inclusive, of Maps, in the office of
the County Recorder of Los Angeles County,
bounded and described as follows:

Beglnning at the most southerly corner
of said lot, sald corner lying ln the
northeasterly Ilne of the strip of land,
10 feet wlde, shown as Walk on the map
of sald tract; thence northeasterly along
the southeasterly 11ne of sald lot a
dlstance of 15 feet; thence northwesterly
at rlght angles from sald southeasterly
llne to the northwesterly line of said
lot; then southwesterly along sald
northwesterly line to the southwesterly
llne of said lot; thence southeasterly
along sald southwesterly line to the
DOlnt of beglnnlng.
The Clty Council of the City of Santa Monica further
finds and determines that the acqulsltlon of all of the above
descrlbed real property 15 necessary for the development and
constructlon of sald publlC way.
SECTION 3.
That the Clty Councll of the Clty of Santa
Monlca flnds and determlnes:
A. That a publlC walkway lS a use authorlzed by law.
B. That the ?ubllC lnterest, convenience and necesslty
require the acqulsitlon of sald easement for a publlc walkway.
C. That the acquisltlon of the easement to sald real
~rogerty lS necessary for the constructlon and development of
a public walkway.

D. That said easement to be used for said publlC
walkway, 1S located in a manner WhlCh w111 be most compatlble
for the greatest publlC good and the least orlvate lnjury.
E. That the property wll1 be acqulred under authorlty
of Callfornia Government Code Sectlon 37350.5.
SECTION 4. That the City Attorney of the City of Los
Angeles is hereby authorlzed, empowered and dlrected to bring
an actlon or actions in the name of the Clty of Santa Monlca
ln the Superlor Court of the State of Californla, for the
County of Los Angeles, for the condemnatlon of the easement
In and to the real ~roperty described ln Sectlon 2 of thlS
resolution, and to take all steps necessary for the condemna-
tion of the easement to sald real ~roperty ln the name of the
Clty of Santa Monlca, and to acquire lmmedlate 9ossesslon of
all of said property.
SECTION 5. The City Clerk shall certlfy to the ado~tion
of thlS resolutlon, and thenceforth and thereafter the same
shall be In full force and effect.
