R-5519 I -' .-1 e . e I RESOLUTION NO. 5519;, (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPER- INTENDENT OF STREETS REGARDING TREE PLANTING DISTRICTS NOS. 1 AND 2 ON SANTA MONICA BOULEVARD. WHEREAS, the City Council of the Clty of Santa Monlca, pur- suant to Section 5870, et seq., of the Streets and Highways Code, commenced proceedlngs to cause the planting of trees on Santa Monica Boulevard from Lincoln Boulevard to 14th Street in the City of Santa Monica, and WHEREAS, a publlC hearing was held on said matters, and thereafter said City Council ordered said planting to be accomplished; and WHEREAS, slxty (60) days after said order was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets did file wlth the City Council of the City of Santa Monica his reports of such work, and a hearing thereon was called by Resolution No. 5482 (C.C.S.); and WHEREAS, the City Council conducted a noticed hearing to consi- der any protests or objections to the Reports of the Work. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Report of Work of the Superintendent of Streets heretofore filed and above descrlbed, be and the same lS hereby conflrmed. SECTION 2. That all of said protests and objections of every . e. e - kind and nature to the planting or to the assessments and all appeals therefrom to said City Counc11 be and the same hereby are overruled and denied. SECTION 3. That the cost of the planting, as set forth in said Reports, shall be assessed against the properties herein described, which propert1es front upon the 1mprovement so planted. SECTION 4. That if such assessment is not paid within the time permitted by law, the same shall constitute a spec1al assessment and lien against the properties therein descr1bed, in the amount set forth in said Report, which lien shall continue unt11 the assessment and all interest thereon is paid. SECTION 5. That if the assessment is not paid within the time permitted, the City Clerk shall deliver a Notice of Lien, slgned by the Super1ntendent of Streets, as provided 1n Section 5891 of the Streets and Highways Code of the State of California, to the County Assessor and Tax Collector, who, in accordance with applicable law, shall collect said assess- ment, together with all other taxes relating to such property. SECTION 6.
