RESOLUTION NO. 5561
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA CONFIRMING THE REPORT OF THE SUPER-
INTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED
SI DEV/ALKS, DRIVBJAYS AND CURBS (SR-80-3)
WHEREAS, the Street Superlntendent of the City of Santa Monica, pur-
suant to Section 5600 to 5630 of the Streets and H1ghways Code, commenced
proceedings to cause the repair of damaged sidewalks, driveways and curbs
in the City of Santa Mon1ca. and
WHEREAS, Slxty (60) days after sa1d order was served, the work had
not been completed by the owners or persons 1n possession of the affected
propert1es, and the Superintendent of Streets caused the work to be done; and
WHEREAS, tne Superin:~ndpnt of Streets did f1le with the City
Counc1l of the City of Santa Mon1ca h1S reports of such work, and a hearing
thereon was called by Resolut1on No.5529 (C.C.S.); and
WHEREAS, the Clty Council conducted a notlced hearing to conslder
any protests or ObJ~ctlons to the Reports of the Work.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS'

SECTION 1. That the Report of Work of the Superintendent of
Streets heretofore flled and above descrlbed, be and the same 15 hereby
confirmed.
SECTION 2. That all of sald protests and obJectlons of every
kind and nature to the repalrs or to the assessments and all appeals therefrom
to sald Clty Councll be and the same hereby are overruled and denled.

SECTION 3. That the cost of the repairs, as set forth in said
Report. shall be assessed aga1nst the propert1es herein descr1bed. which
properties front upon the improvement so constructed.
SECTION 4. That if such assessment is not pa1d withlP the
t1me permitted by law the same shall constitute a special assessment and
llen against the propert1es there1n described, in the amount set forth
in said Report, which lien shall contlnue until the assessment and all
interest thereon is paid.
SECTION 5. That if the assessment 1S not paid with1n the
time permltted, the City Clerk shall deliver a Notice of Lien, slgned by
the Superlntendent of Streets. as provided in Section 5626 of the Streets
and Highways Code of the State of Californla, to the County Assessor and
Tax Collector, who, in accordance with appllcable law, shall collect said
assessment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall cert1fy to the adoption
of this Resolut1on.
