A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF
STREETS REGARDING TREE PLANTING DISTRICT NO. 3 ON SANTA
MONICA BOULEVARD.
WHEREAS, the City Council of the City of Santa Monica, pursuant
to Section 5870, et seq.. of the Streets and Hlghways Code. commenced pro-
ceedings to cause the planting of trees on Santa Monica Boulevard from 5th
Street to Lincoln Boulevard in the City of Santa Monica, and
WHEREAS. a publiC hearing was held on said matters. and there-
after sald City Council ordered said planting to be accomplished; and
WHEREAS, Slxty (60) days after sald order was served. the work had
not been completed by the owners or persons in possession of the affected
properties. and the Superintendent of Streets caused the work to be done; and
WHEREAS, the Superintendent of Streets dld file with the City Council
of the City of Santa Monica his reports of such work. and a hearing thereon
was ca11ed by Resolution No. 5545 (CCS); and
WHEREAS, the City Council conducted a notlced hearing to consider
any protests or objections to the Reports of the Work.
NOW, THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES
RESOLVE AS FOLLOWS:
SECTION 1. That the Report of Work of the Superintendent of Streets
heretofore filed and above described, be and the same is hereby confirmed.
SECTION 2. That all of said protests and objections of every kind
and nature to the planting or to the assessments and all appeals therefrom to
said City Council be and the same hereby are overruled and denied.

SECTION 3. That the cost of the planting, as set forth in said
Reports, shall be assessed against the properties herein descrlbed, which
properties front upon the improvement so planted.
SECTION 4. That if such assessment is not paid within the time
permitted by law. the same shall constitute a special assessment and lien
against the properties therein described. in the amount set forth in said
Report, which lien shall continue until the assessment and all interest thereon
is paid.
SECTION 5. That if the assessment is not paid within the ti~e
permitted, the City Clerk shall deliver a Notlce of Lien. slgned by the
Superintendent of Streets, as provided in Section 5891 of the Streets and
Highways Code of the State of Californla. to the County Assessor and Tax
Collector. who, in accordance with applicable law, shall collect said assess-
ment, together with all other taxes relating to such property.
SECTION 6. That the City Clerk shall certify to the adoption of
this Resolution.
