RESOLUTION NO. 5371 (CCS)
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA MONICA ORDERING THE VACATION OF A PORTION
OF THAT CERTAIN ALLEY KNOWN AS FIRST COURT IN THE
CITY OF SANTA ~IDNICA, CALIFORNIA.
THE CITY COUNCIL OF THE CITY OF SANTA tIDNICA DOES RESOLVE AS FOLLOWS:
SECTION 1. That the City Council of the City of Santa Monica
having heard the evidence offered in relation to the proposed vacation of
that portion of the alley known as First Court, 20 feet wide, from
Arizona Avenue to 200 feet northwesterly, as shown on amended map of
Town of Santa Monica recorded in Book 39, pages 45 et seq. of Miscellaneous
Records, in the office of the Recorder of Los Angeles County, hereby finds
from all of the evidence submitted that the portion of the court above
referred to and proposed to be vacated by Resolution No. 5335 (City Council
Series) is unnecessary for present or prospective street purposes. For full
particulars reference hereby is made to said Resolution No. 5335 (City
Council Series) and to Map No. 4246 on file in the office of the City Clerk
of said City; which map is entitled, ItMap Showing Portion of First Court
to be Vacated Under the Provisions of the Street Vacation Act of 1941,11 dated
June 28, 1979.
SECTION 2. The City Council of the City of Santa Monica, in
vacating said portion of First Court, makes the vacation contingent on the
following conditions to the satisfaction of the City Engineer:
1. Certain property be dedicated for a new alley connecting
First Court to Second Street.
2. Construction of a new alley connecting First Court to
Second Street.

3. Dedication of easement for utilities connecting First
Court to Ocean Avenue.
4. Rerouting of all required utilities between First Court
and Ocean Avenue.
5. Rerouting of water mains between First Court and Second Street.
6. Provide positive storm water drainage for the new alley, and
hold the City forever harmless against damages.
7. The building being proposed requiring this alley vacation, be
built to the plans and conditions approved by the City.
8. All of the required work necessary for this vacation shall be
done at no cost to the City.
SECTION 3. It is~ therefore, ordered that said portion of First
Court as shown on the City of Santa Monica Drawing No. 4246, dated June 28~
1979, ;s hereby vacated.
SECTION 4. The City Clerk shall certify to the adoption of thlS
resolution and the same shall be in full force and effect on and after
August 14.
, 1979. The City Clerk shall also cause a copy of
this resolution to be recorded in the office of the County Recorder of the
County of Los Angeles.
