RESOLUTION 5436
(CITY COUNCIL SERIES)
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SANTA ~roNICA SETTING A HEARING FOR THE PURPOSE OF
DETERMINING WHETHER OR NOT THE PUBLIC NECESSITY,
HEALTH, SAFETY, OR WELFARE REQUIRES THE REMOVAL
OF POLES, OVERHEAD WIRES, AND ASSOCIATED OVERHEAD
STRUCTURES AND THE UNDERGROUND INSTALLATION OF
WIRES AND FACILITIES FOR SUPPLYING ELECTRIC
COMMUNICATION OR SIMILAR OR ASSOCIATED SERVICE
FOR THE DISTRICT KNOWN AS FIRST COURT BETWEEN
COLORADO AVENUE AND WILSHIRE BLVD.
WHEREAS, the City Council on June 25, 1968; did adopt
Ord1nance No. 773 (City Council Series); adding Chapter 9 to Article VII
of the Santa Monica Municipal Code, which Chapter is titled as follows:
ItCHAPTER 9 - REGULATIONS AND PROCEDURES RE OVERHEAD AND
UNDERGROUND UTILITY FACILITIES, II and
WHEREAS, the City Council desires to designate First Court
from Colorado Avenue to Wilshire Boulevard an Underground Utility District; and
WHEREAS, the City Council of the City of Santa Monica hereby
finds that such udnergrounding is in the general public interest for the
following reasons:
1. Such undergrounding will eliminate an unusually heavy
concentration of overhead distri~ution facilities;
2. Said alley is extensively used by the general public
and carries a heavy volume of vehicular traffic; and
3. Said alley passes through an area which would benefit
from the aesthetic improvement resulting from such
undergrounding; and

WHEREAS, the Southern California Edison Company and the
General Telephone Company desire to accomplish the undergrounding of this
1 i ne by February 1, 1980;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOLLOWS:
SECTION 1. That said City Council proposes to initiate
proceedings for the establishment of an Underground Utility Distrlct embracing
First Court from Colorado Avenue to Wilshire Blvd, together with property
abutting said First Court within sald limits.
SECTION 2. That notice hereby is given that on Tuesday, the
11th day of December, 1979, at 7:30 p.m. in the Council Chambers located in
the City Hall, 1685 Main Street, Santa Monica, California, there shall be a
public hearing before said City Council for the purpose of determining whether
the public necessity, health, safety, or welfare requires the above descrlbed
improvement.
SECTION 3. That the City Clerk shall give notice of the hearing
by posting a copy of this resolution on the Councll Chamber door and by
notlfying all affected property owners as shown on the last equallzed assess-
ment roll, and utility companies concerned, by mall of the time and place of
such hearing at least ten days prior to the date thereof.
SECTION 4. That the City Clerk hereby is dlrected to publish
this resolution in the Evening Outlook on two successive dates, the flrst
publication to be made not less than ten days prlor to the date of the
above public hearlng.
SECTION 5. The Clty Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full force
and effect.
