RESOLUTION NO. 5439 (City Council Series) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO ORDER THE VACATION OF THAT CERTAIN STREET KNOWN AS TWENTY- SECOND STREET FROM PENNSYLVANIA AVENUE TO OLYMPIC BOULEVARD IN THE CITY OF SANTA MONICA. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the City Council of the City of Santa Monica hereby declares its intention to order the vacation of all of that portion of Twenty-second Street from Pennsylvania Avenue to Olympic Boulevard, as shown on the map of Erkenbrecher Syndicate Santa Monica Tract, in the City of Santa Monica, County of Los Angeles, State of California, recorded in book 6, Pages 26&27 of maps in the office of the Recorder of said County. For further particulars as to the proposed vacatlon and abandon- ment of the hereinbefore mentioned areas, reference is made to Map No. 4241 dated October 11,1979, now on file in the office of the City Clerk in the City Hall, Santa Monica, California. SECTION 2. The City Council of the City of Santa Monica, in vacating said portion of said Twenty-second Street, hereby intends to make said vacation condltional on the reservation of the street as a storm water conductor to the existing catch basins at its northwesterly terminus. Any changes in the street drainage shall be approved by the City Engineer. SECTION 3. The City Council of the City of Santa Monica, in vacating the above-mentloned portion of Twenty-second Street from . . -2- Pennsylvania Avenue to Olympic Boulevard, elects to proceed under and in accordance with the provisions of the IlStreet Vacation Act of 1941,11 being Division g, Part 3, of the Streets and Highways Code of the State of Cal ifornia. SECTION 4. That the hour of 7:30 p.m. of the 11th day of December, 1979, in the Council Chamber in the City Hall, Santa Monica, California, be and the same hereby is fixed as the t1me and place when and where all persons interested in or objecting to the proposed vacation and abandonment may appear before the City Council and offer eV1dence 1n relation thereto. SECTION 5. That the Street Superintendent of the City of Santa Monica hereby 1S directed to cause Notices of Street Vacation to be posted as required by the Street Vacat10n Act of 1941, Being Div1sion 9, Part 3 of the Streets and Highways Code, and the City Council hereby elects to proceed under the provis1ons of said act. SECTION 6. The City Clerk shall certify to the adoption of th1S Resolution of Intention and shall cause the same to be published twice in the Evening Outlook, a newspaper published and circulated in the City of Santa Monica. The first of said publications shall be not less than fifteen days prior to Oecember 11, 1979. SECTION 7.
