T-79-4- SM RESOLUTION NO. 6069 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPERINTENDENT OF STREETS REGARDING TREE PLANTING DISTRICT NO.4 ON SANTA MONICA BOULEVARD. WHEREAS, the City Council of the City of Santa Monica, pursuant to Sect10n 5870, et seq., of the Streets and Highways Code, commenced pro- ceedings to cause the planting of trees on Santa Monica Boulevard from 14th Street to 17th Street 1n the City of Santa Monica, and WHEREAS, a publ1C hearing was held on sa1d matters, and there- after said City Counc1l ordered said planting to be accomplished; and WHEREAS, sixty days after said order was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superintendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets did file w1th the City Council Of the City of Santa Mon1ca his reports of such work, and a hear1ng thereon was called by Resolut1on No. 6050 (CCS); and WHEREAS, the City Council conducted a noticed hearing to consider any protests or obJect1ons to the Reports of the Work. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Report of Work of the Superintendent of Streets heretofore filed and above described, be and the same is hereby confirmed. SECTION 2. That all of sa1d protests and objections of every kind and nature to the planting or to the assessments and all appeals therefrom to said City Council be and the same hereby are overruled and denied. . . SECTION 3. That the cost of the planting, as set forth 1n said Reports, shall be assessed against the properties herein described, which properties front upon the improvement so planted. SECTION 4. That if such assessment is not paid within the time permitted by law, the same shall constitute a special assessment and lien against the properties there1n descrlbed, in the amount set forth in said Report, which llen shall continue until the assessment and all interest thereon is paid. SECTION 5. That if the assessment is not paid w1th1n the t1me permitted, the City Clerk shall deliver a Notice of Lien, signed by the Superintendent of Streets, as provided in Section 5S91 of the Streets and Highways Code of the State of Cal1fornia, to the County Assessor and Tax Collector, who, in accordance with appl1cable law, shall collect said assess- ment, together w1th all other taxes relating to such property. SECTION 6. That the City Clerk shall certify to the adootion of this Resolution. APPROVED AS TO FORM: . . .
