R-6072 A! - r .... . .SO-b) RESOLUTION NO. 6072 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA CONFIRMING THE REPORT OF THE SUPER- INTENDENT OF STREETS REGARDING REPAIRS TO DAMAGED SIDEWALKS, DRIVEWAYS AND CURBS (SR-BO-6) WHEREAS, the Street Superintendent of the Clty of Santa Monlca, pursuant to Sectlon 5600 to 5630 of the Streets and Hlghways Code, commenced proceedings to cause the repalr of damaged sldewalks, drlveways and curbs in the City of Santa Monica, and WHEREAS, Slzty days after sald order was served, the work had not been completed by the owners or persons in possession of the affected properties, and the Superlntendent of Streets caused the work to be done; and WHEREAS, the Superintendent of Streets did file with the Clty Council of the City of Santa Monica his reports of such work, and a hearlng thereon was called by Resolutlon No. 6049 (CCS); and WHEREAS, the Clty Councll conducted a noticed hearlng to conslder any protests or objectlons to the Reports of the Work. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the Report of Work of the Superintendent of Streets heretofore flIed and above described, be and the same is hereby confirmed. SECTION 2. That the protest and objection of the owners of the property at 2102 Marine Street is hereby granted, and said owners are exempted from assessment, and that all other protests . . and objections of every kind and nature to the repa1rs or to the assessments and all appeals therefrom to said City Council be and the same hereby are overruled and denied. SECTION 3. That the cost of the repa~rs, as set forth in said Report, shall be assessed aga1nst the propert1es described therein, wh1ch properties front upon the improvement so constructed. SECTION 4. That if such assessment is not paid within the t1me permitted by law the same shall constitute a special assessment and lien aga1nst the properties therein described, 1n the amount set forth in said Report, which lien shall cont1nue until the assessment and all 1nterest thereon is paid. SECTION 5. That if the assessment is not paid within the t1rne permittedl the City Clerk shall deliver a Notice of Lien, signed by the Superintendent of Streets, as prov1ded in Sect10n 5626 of the Streets and H1ghways Code of the State of California, to the County Assessor and Tax Collector, who, in accordance with applicable law, shall collect sa1d assessment, together w1th all other taxes relating to such property.
