R-6096 ~ na RESOLUTION NO.6096 (CITY COUNCIL SERIES) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA MONICA DECLARING ITS INTENTION TO PLANT TREES AND CO~STRUCT CONCRETE SIDEWALKS ALONG ThE EAST SIDE OF NEILSON WAY FROM PICO BOULEVARD TO HOLLISTER AVENUE~ ALL WITHIN THE CITY OF SANTA MONICA WHEREAS~ the City Council of the City of Santa Monica 1S empowered by Section 5870, et seq., of the Streets and Highways Code of the State of California to plant trees and construct sidewalks at various locations w1thin the City of Santa Monica; NOW. THEREFORE. THE CITY COUNCIL OF THE CITY OF SANTA MONICA DOES RESOLVE AS FOLLOWS: SECTION 1. That the publ1C interest requires and 1t 1S the intent10n of the City Council of the City of Santa Monica to order the follow1ng work to be done. to wit: The planting of trees and the construc- tion of concrete sidewalks along the east side of Nellson Way from Pica Boulevard to Hollister Avenue all in the Clty of Santa Monica. The estl- mated assessment cost of the tree i~provement is $1.75 per front foot to the abuttlng property owners and the balance of the cost is to be borne by the City. The estlmated assessment cost of the sidewalk constructlon 1S S10.00 per front foot to the abutt1ng property owners. SECTION 2. That said proposed work or improvement, in the opinion of the City Council of the City of Santa Monica. is of more than local or ordinary public benefit, and sald Council hereby proposes that the district in the City of Santa Monica to be benefited by sa1d work or lmprovement and to be assessed to pay the cost and expense thereof includes all of the property abutting the east slde of ~eilson lJay between Pico Boulevard and Hollister Avenue. -1- . . SECTION 3. Notice hereby is given pursuant to said Section 5870 et seq., that on November 11~ 1980~ at the hour of 7:30 p.m. in the Council Chambers of the City Hall of said City of Santa Monica~ situated at 1685 Main Street in said City, any and all persons having any objections to the proposed work or improvement may appear before the C1ty Council and show cause why the said proposed \,Iork or improvel"1ent should not be carried out 1n accordance with said Resolution of Intention. SECTION 4. The Superintendent of Streets immediately shall cause to be conspicuously posted along the llne of said contemplated improvement notice of the passage of thlS Resolution of Intent10n in the manner and form prescr1bed by law. The City Clerk hereby is directed to mail notices~ in the manner and form prescribed by law~ of the adoption of this resolution to all persons owning real property in the hereinbefore described assess- ment district, whose names and addresses appear on the last equalized roll for city taxes or as known to the City Clerk. SECTION 5. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
