A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA
MONICA SETTING A HEARING FOR THE PURPOSE OF DETERMINING
WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE
THE CONSTRUCTION OF STREET LIGHTING AND APPURTENANT WORK ON
SUNSET AVENUE BETWEEN SEVENTEENTH STREET AND DEWEY STREET.
ALL WITHIN THE CITY OF SANTA MONICA.
WHEREAS. Sectlon 19 of Artlcle XVI of the Constltution of the State
of Californla provldes that the debt limltation and maJority protest provisions
of sa1d section shall not apply 1f, after the giving of such reasonable not1ce
by publlcat10n and posting and the holding of such public hearing as the City
Counc11 of the City of Santa Monica shall have prescribed. sa1d Council by no
less than a 4j5ths vote of all members thereof, finds and determ1nes that the
pub11C convenience and necesslty require the proposed 1mprovement to be made; and
WHEREAS. Section 2804 of the Streets and Highways Code of the State
of California provides that the IlSpecial Assessment, Investigation, llmitat10n
and Majority Protest Act of 1931" shall not apply to any proceed1ng otherwise
subJect thereto when sa1d 1mprovement proceeding 1S by a charter city and said
C1ty has complied w1th the provislons of Sect10n 19 of Article XVI of the
Const1tut1on of the State of Cal1fornia; and
WHEREAS, The C1ty of Santa Monica 15 a charter C1ty of the State
of Californ1a.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SANTA MONICA
DOES RESOLVE AS FOllOWS'
SECTION 1. That said City Counc1l proposes to 1nitlate proceedings
for the construction of street 11ghting and appurtenant work on Sunset Avenue
between Seventeenth Street and Dewey Street.

SECTION 2. That the total estimated cost of the proposed
improvement is $34,QOO.00.
SECTION 3. That the said improvement shall be conducted under the
Improvement Act of 1911, WhlCh is Dlvis10n 7 of the Streets and H1ghways
Code of the State of Ca11forn1a.
SECTION 4. That notice hereby is glven that on Tuesday, the
11th day of November, 1980, at 7:30 p.m. in the Council Chamber located ln the
C1ty Hall, 1685 Main Street, Santa Monica, California, there shall be a publlC
hear1ng before said City Council for the purpose of determ1ning whether the
publ1c convenience and necessity require the above descrlbed improvement.
SECTION 5. That the City Clerk shall give notice of the hearlng
by postlng a copy of th1S resolut1on 1n the manner described by Section 5065
of the Streets and Highways Code and by publ1cation as hereinafter provided.
Any person interested may make protest agalnst the proposed lmprovement in
wr1tlng flled with the City Clerk at any tlme not later than the hour set for
the hearing ln the manner provlded by Section 5220 of the Streets and Hlghways
Code.
SECTION 6. That the City Clerk hereby 1S d1rected to publish this
resolution in the Evening Outlook on two successive dates, the first publicat10n
to be made not less than ten days prior to the date of the above publ1C hearing.
SECTION 7. The City Clerk shall certify to the adoptlon of this
resolution and thenceforth and thereafter the same shall be 1n full force and
effect.
